Health maintenance organization producers shall comply with\n\nall applicable statutes and provisions of Title 36 of the Oklahoma\n\nStatutes and rules relating to producer licensing, including the\n\nOklahoma Producer Licensing Act.\n\nB. The following persons shall not be required to hold a health\n\nmaintenance organization producer license:\n\n1. A regular salaried officer or employee of a health\n\nmaintenance organization who devotes substantially all of his or her\n\ntime to activities other than the taking or transmitting of\n\napplications or membership fees or premiums for health maintenance\n\norganization membership, or who receives no commission or other\n\ncompensation directly dependent upon the business obtained, and who\n\ndoes not solicit or accept from the public applications for health\n\nmaintenance organization membership;\n\n2. Employers or their officers or employees or the trustees of\n\nan employee benefit plan to the extent that the employers, officers,\n\nemployees or trustees are engaged in the administration or operation\n\nof a program of employee benefits involving the use of health\n\nmaintenance organization memberships; provided, that the employers,\n\nofficers, employees or trustees are not in any manner compensated\n\ndirectly or indirectly by the health maintenance organization\n\nissuing health maintenance organization memberships;\n\n3. Banks or their officers and employees to the extent that the\n\nbanks, officers and employees collect and remit charges by charging\n\nthem against accounts of depositors on the orders of the depositors;\n\nor\n\n4. A person or the employee of a person who has contracted to\n\nprovide administrative, management or health care services to a\n\nhealth maintenance organization and who is compensated for those\n\nservices by the payment of an amount calculated as a percentage of\n\nthe revenues, net income or profit of the health maintenance\n\norganization, if that method of compensation is the sole basis for\n\nsubjecting that person or the employee of the person to this act.\n\nC. The Insurance Commissioner may by rule exempt certain\n\nclasses of persons from the requirement of obtaining a license:\n\n1. If the functions such persons perform do not require special\n\ncompetence, trustworthiness or the regulatory surveillance made\n\npossible by licensing; or\n\n2.
