Stat. tit. 36, § 36-6918","heading":"Organizations permitted to organize and operate health","body":"maintenance organization - Contracts for insurance against cost of\n\ncare provided.\n\nA. An insurance company licensed in this state or a hospital or\n\nmedical service corporation authorized to do business in this state\n\nmay either directly or through a subsidiary or affiliate organize\n\nand operate a health maintenance organization pursuant to the\n\nprovisions of this act. Notwithstanding any other law which may be\n\ninconsistent, any two or more insurance companies, hospital or\n\nmedical service corporations, or subsidiaries or affiliates thereof\n\nmay jointly organize and operate a health maintenance organization.\n\nThe business of insurance is deemed to include the providing of\n\nhealth care by a health maintenance organization owned or operated\n\nby an insurer or its subsidiary.\n\nB. Notwithstanding any provision of insurance and hospital or\n\nmedical service corporation laws in Title 36 of the Oklahoma\n\nStatutes, an insurer or a hospital or medical service corporation\n\nmay contract with a health maintenance organization to provide\n\ninsurance or similar protection against the cost of care provided\n\nthrough health maintenance organizations and to provide coverage in\n\nthe event of the failure of the health maintenance organization to\n\nmeet its obligations. The enrollees of a health maintenance\n\norganization constitute a permissible group under such laws.
