Stat. tit. 36, § 36-6919","heading":"Examination of affairs, programs, books, and records -","body":"Payment of expenses.\n\nA. The Insurance Commissioner may make an examination of the\n\naffairs of any health maintenance organization, producers and\n\nproviders with whom the organization has contracts, agreements or\n\nother arrangements pursuant to the provisions of Sections 309.1\n\nthrough 309.7 of this title.\n\nB. The Insurance Commissioner may require a health maintenance\n\norganization to contract for an examination concerning the quality\n\nassurance program of the health maintenance organization and of any\n\nproviders with whom the organization has contracts, agreements or\n\nother arrangements as often as is reasonably necessary for the\n\nprotection of the interests of the people of this state, but not\n\nless frequently than once every three (3) years.\n\nC. Every health maintenance organization and provider shall\n\nsubmit its books and records for examination and in every way\n\nfacilitate the completion of an examination. For the purpose of an\n\nexamination, the Insurance Commissioner may administer oaths to, and\n\nexamine the officers and agents of the health maintenance\n\norganization and the principals of the providers concerning their\n\nbusiness.\n\nD. Any health maintenance organization examined shall pay the\n\nproper charges incurred in such examination, including the actual\n\nexpense of the Insurance Commissioner or the expenses and\n\ncompensation of any authorized representative and the expense and\n\ncompensation of assistants and examiners employed therein. All\n\nexpenses incurred in such examination shall be verified by affidavit\n\nand a copy shall be filed in the office of the Insurance\n\nCommissioner.\n\nE.
