Stat. tit. 36, § 36-6938","heading":"Definitions","body":"As used in the Risk-based Capital (RBC) for Health Maintenance\n\nOrganizations Act of 2003:\n\n1. “Adjusted Risk-based Capital (RBC) report” means an RBC\n\nreport which has been adjusted by the Insurance Commissioner in\n\naccordance with the provisions of subsection C of Section 39 of this\n\nact;\n\n2. “Corrective order” means an order issued by the Commissioner\n\nspecifying corrective actions which the Insurance Commissioner has\n\ndetermined are required;\n\n3. “Domestic health maintenance organization” means a health\n\nmaintenance organization domiciled in this state;\n\n4. “Foreign health maintenance organization” means a health\n\nmaintenance organization that is licensed to do business in this\n\nstate under the Health Maintenance Organization Act of 2003, but is\n\nnot domiciled in this state;\n\n5. “NAIC” means the National Association of Insurance\n\nCommissioners;\n\n6. “Health maintenance organization” means a health maintenance\n\norganization licensed under the Health Maintenance Organization Act\n\nof 2003. This definition does not include an organization that is\n\nlicensed as either a life and health insurer or a property and\n\ncasualty insurer under Title 36 of the Oklahoma Statutes and that is\n\notherwise subject to either life or property and casualty RBC\n\nrequirements;\n\n7. “RBC instructions” means the RBC report including risk-based\n\ncapital instructions adopted by the NAIC, as these RBC instructions\n\nmay be amended by the NAIC from time to time in accordance with the\n\nprocedures adopted by the NAIC;\n\n8. “RBC level” means a health maintenance organization’s\n\nCompany Action Level RBC, Regulatory Action Level RBC, Authorized\n\nControl Level RBC, or Mandatory Control Level RBC where:\n\na. “Company Action Level RBC” means, with respect to any\n\nhealth maintenance organization, the product of 2.0\n\nand its Authorized Control Level RBC,\n\nb. “Regulatory Action Level RBC” means the product of 1.5\n\nand its Authorized Control Level RBC,\n\nc. “Authorized Control Level RBC” means the number\n\ndetermined under the risk-based capital formula in\n\naccordance with the RBC instructions, or\n\nd. “Mandatory Control Level RBC” means the product of .70\n\nand the Authorized Control Level RBC;\n\n9. “RBC plan” means a comprehensive financial plan containing\n\nthe elements specified in subsection B of Section 40 of this act.\n\nIf the Insurance Commissioner rejects the RBC plan, and it is\n\nrevised by the health maintenance organization, with or without the\n\nInsurance Commissioner’s recommendation, the plan shall be called\n\nthe “revised RBC plan”;\n\n10. “RBC report” means the report required in Section 39 of\n\nthis act; and\n\n11. “Total adjusted capital” means the sum of:\n\na. a health maintenance organization’s statutory capital\n\nand surplus, or its net worth, as determined in\n\naccordance with the statutory accounting applicable to\n\nthe annual financial statements required to be filed\n\nunder Section 9 of this act, and\n\nb. such other items, if any, as the RBC instructions may\n\nprovide.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b9bbd1f277c34b617ba4996622ca612ce58dcb39ce3a06da8de1d97630045bf3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6937","next":"us-ok/okla.-stat.-tit.-36-36-6939"},"notice":"GroundRules: Original legal text.
