Stat. tit. 36, § 36-6939","heading":"Report of Risk-based Capital (RBC) levels - Formula -","body":"Adjustment by Commissioner.\n\nA. A domestic health maintenance organization shall, on or\n\nprior to each March 1 filing date, prepare and submit to the\n\nInsurance Commissioner a report of its Risk-based Capital (RBC)\n\nlevels as of the end of the calendar year just ended, in a form and\n\ncontaining such information as is required by the RBC instructions.\n\nIn addition, a domestic health maintenance organization shall file\n\nits RBC report:\n\n1. With the National Association of Insurance Commissioners\n\n(NAIC) in accordance with the RBC instructions; and\n\n2. With the Insurance Commissioner in any state in which the\n\nhealth maintenance organization is authorized to do business, if the\n\nInsurance Commissioner has notified the health maintenance\n\norganization of its request in writing, in which case the health\n\nmaintenance organization shall file its RBC report not later than\n\nthe later of:\n\na. fifteen (15) days from the receipt of notice to file\n\nits RBC report with that state, or\n\nb. the filing date.\n\nB. A health maintenance organization’s RBC shall be determined\n\nin accordance with the formula set forth in the RBC instructions.\n\nThe formula shall take the following into account and may adjust for\n\nthe covariance between, determined in each case by applying the\n\nfactors in the manner set forth in the RBC instructions:\n\n1. Asset risk;\n\n2. Credit risk;\n\n3. Underwriting risk; and\n\n4. All other business risks and such other relevant risks as\n\nare set forth in the RBC instructions.\n\nC. If a domestic health maintenance organization files an RBC\n\nreport that, in the judgment of the Commissioner, is inaccurate, the\n\nCommissioner shall adjust the RBC report to correct the inaccuracy\n\nand shall notify the health maintenance organization of the\n\nadjustment. The notice shall contain a statement of the reason for\n\nthe adjustment.
