Stat. tit. 36, § 36-6942","heading":"Authorized control level event - Definition - Duties of","body":"Insurance Commissioner.\n\nA. “Authorized Control Level Event” means any of the following\n\nevents:\n\n1. The filing of an RBC report by the health maintenance\n\norganization that indicates that the health maintenance\n\norganization’s total adjusted capital is greater than or equal to\n\nits Mandatory Control Level RBC, but less than its Authorized\n\nControl Level RBC;\n\n2. The notification by the Commissioner to the health\n\nmaintenance organization of an adjusted RBC report that indicates an\n\nAuthorized Control Level Event as specified in paragraph 1 of this\n\nsubsection, provided the health maintenance organization does not\n\nchallenge the adjusted RBC report under Section 44 of this act;\n\n3. If, pursuant to the provisions of Section 44 of this act,\n\nthe health maintenance organization challenges an adjusted RBC\n\nreport that indicates the event in paragraph 1 of this subsection,\n\nnotification by the Commissioner to the health maintenance\n\norganization that the commissioner has, after a hearing, rejected\n\nthe health maintenance organization’s challenge;\n\n4. The failure of the health maintenance organization to\n\nrespond, in a manner satisfactory to the Commissioner, to a\n\ncorrective order, provided the health maintenance organization has\n\nnot challenged the corrective order under Section 44 of this act; or\n\n5. If the health maintenance organization has challenged a\n\ncorrective order under Section 44 of this act and the Commissioner\n\nhas, after a hearing, rejected the challenge or modified the\n\ncorrective order, the failure of the health maintenance organization\n\nto respond, in a manner satisfactory to the Commissioner, to the\n\ncorrective order subsequent to rejection or modification by the\n\nCommissioner.\n\nB. In the event of an Authorized Control Level Event with\n\nrespect to a health maintenance organization, the Commissioner\n\nshall:\n\n1. Take such actions as are required under Section 41 of this\n\nact regarding a health maintenance organization with respect to\n\nwhich a Regulatory Action Level Event has occurred; or\n\n2. If the Commissioner deems it to be in the best interests of\n\nthe policyholders and creditors of the health maintenance\n\norganization and of the public, take such actions as are necessary\n\nto cause the health maintenance organization to be placed under\n\nregulatory control pursuant to the provisions of Articles 18 and 19\n\nof the Insurance Code. In the event the Commissioner takes such\n\nactions, the Authorized Control Level Event shall be deemed\n\nsufficient grounds for the Commissioner to take action pursuant to\n\nthe provisions of Articles 18 and 19 of the Insurance Code, and the\n\nCommissioner shall have the rights, powers and duties with respect\n\nto the health maintenance organization as provided in Articles 18\n\nand 19 of the Insurance Code.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f40934a3e5c93e318c77a9afa4826dbe0feb055041123fa69ad399d4a0eabb57","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6941","next":"us-ok/okla.-stat.-tit.-36-36-6943"},"notice":"GroundRules: Original legal text.
