Stat. tit. 36, § 36-6943","heading":"Mandatory control level event - Definition - Duties of","body":"Insurance Commissioner.\n\nA. “Mandatory Control Level Event” means any of the following\n\nevents:\n\n1. The filing of an RBC report which indicates that the health\n\nmaintenance organization’s total adjusted capital is less than its\n\nMandatory Control Level RBC;\n\n2. Notification by the Commissioner to the health maintenance\n\norganization of an adjusted RBC report that indicates a Mandatory\n\nControl Level Event specified in paragraph 1 of this subsection,\n\nprovided the health maintenance organization does not challenge the\n\nadjusted RBC report under Section 44 of this act; or\n\n3. If, pursuant to the provisions of Section 44 of this act,\n\nthe health maintenance organization challenges an adjusted RBC\n\nreport that indicates the event in paragraph 1 of this subsection,\n\nnotification by the Commissioner to the health maintenance\n\norganization that the Commissioner has, after a hearing, rejected\n\nthe health maintenance organization’s challenge.\n\nB. In the event of a Mandatory Control Level Event, the\n\nCommissioner shall take such actions as are necessary to place the\n\nhealth maintenance organization under regulatory control pursuant to\n\nthe provisions of Articles 18 and 19 of the Insurance Code. In that\n\nevent, the Mandatory Control Level Event shall be deemed sufficient\n\ngrounds for the Commissioner to take action pursuant to the\n\nprovisions of Articles 18 and 19 of the Insurance Code, and the\n\nCommissioner shall have the rights, powers and duties with respect\n\nto the health maintenance organization as provided in Articles 18\n\nand 19 of the Insurance Code. Notwithstanding any of the preceding\n\nprovisions, the Commissioner may forego action for up to ninety (90)\n\ndays after the Mandatory Control Level Event if the Commissioner\n\nfinds there is a reasonable expectation that the Mandatory Control\n\nLevel Event may be eliminated within the ninety-day period.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b77ca718a402e53a09a48d4bfa81562cba5eaf4429bad9b113e84ad051766979","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6942","next":"us-ok/okla.-stat.-tit.-36-36-6944"},"notice":"GroundRules: Original legal text.
