Stat. tit. 36, § 36-6944","heading":"Challenge of determination or action by Insurance","body":"Commissioner - Required events - Hearing.\n\nUpon the occurrence of any of the events specified in this\n\nsection, the health maintenance organization shall have the right to\n\na confidential departmental hearing, on the record, at which time\n\nthe health maintenance organization may challenge any determination\n\nor action by the Insurance Commissioner. The health maintenance\n\norganization shall notify the Commissioner of its request for a\n\nhearing within five (5) days after the notification by the\n\nCommissioner pursuant to the provisions of paragraph 1, 2, 3 or 4 of\n\nthis section. Upon receipt of the health maintenance organization’s\n\nrequest for a hearing, the Commissioner shall set a date for the\n\nhearing, which shall be not less than ten (10), nor more than thirty\n\n(30) days after the date of the health maintenance organization’s\n\nrequest. The events include:\n\n1. Notification to a health maintenance organization by the\n\nCommissioner of an adjusted Risk-Based Capital (RBC) report;\n\n2. Notification to a health maintenance organization by the\n\nCommissioner that:\n\na. the health maintenance organization’s RBC plan or\n\nrevised RBC plan is unsatisfactory, and\n\nb. notification constitutes a Regulatory Action Level\n\nEvent with respect to the health maintenance\n\norganization;\n\n3. Notification to a health maintenance organization by the\n\nCommissioner that the health maintenance organization has failed to\n\nadhere to its RBC plan or revised RBC plan and that the failure has\n\na substantial adverse effect on the ability of the health\n\nmaintenance organization to eliminate the Company Action Level Event\n\nwith respect to the health maintenance organization in accordance\n\nwith its RBC plan or revised RBC plan; or\n\n4.
