A foreign health maintenance organization shall, upon\n\nthe written request of the Insurance Commissioner, submit to the\n\nCommissioner a Risk-Based Capital (RBC) report as of the end of the\n\ncalendar year just ended the later of:\n\na. the date an RBC report would be required to be filed\n\nby a domestic health maintenance organization under\n\nthis act, or\n\nb. fifteen (15) days after the request is received by the\n\nforeign health maintenance organization.\n\n2. A foreign health maintenance organization shall, at the\n\nwritten request of the Commissioner, promptly submit to the\n\nCommissioner a copy of any RBC plan that is filed with the Insurance\n\nCommissioner of any other state.\n\nB. In the event of a Company Action Level Event, Regulatory\n\nAction Level Event or Authorized Control Level Event with respect to\n\na foreign health maintenance organization, as determined under the\n\nRBC statute applicable in the state of domicile of the health\n\nmaintenance organization or, if no RBC statute is in force in that\n\nstate, under the provisions of this act, if the Insurance\n\nCommissioner of the state of domicile of the foreign health\n\nmaintenance organization fails to require the foreign health\n\nmaintenance organization to file an RBC plan in the manner specified\n\nunder that state’s RBC statute or, if no RBC statute is in force in\n\nthat state, under the provisions of Section 40 of this act, the\n\nCommissioner may require the foreign health maintenance organization\n\nto file an RBC plan with the Commissioner. In such event, the\n\nfailure of the foreign health maintenance organization to file an\n\nRBC plan with the Commissioner shall be grounds to order the health\n\nmaintenance organization to cease and desist from writing new\n\ninsurance business in this state.\n\nC. In the event of a Mandatory Control Level Event with respect\n\nto a foreign health maintenance organization, if no domiciliary\n\nreceiver has been appointed for the foreign health maintenance\n\norganization under the rehabilitation and liquidation statute\n\napplicable in the state of domicile of the foreign health\n\nmaintenance organization, the Commissioner may make application to\n\nthe District Court of Oklahoma County as permitted under Article 19\n\nof the Insurance Code with respect to the liquidation of property of\n\nforeign health maintenance organizations found in this state, and\n\nthe occurrence of the Mandatory Control Level Event shall be\n\nconsidered adequate grounds for the application.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f4e9bd04e0e6c03fbb6198b2137a1630df100055b65a723d9eb566c0e4a954fe","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6946","next":"us-ok/okla.-stat.-tit.-36-36-6948"},"notice":"GroundRules: Original legal text.
