Pharmacy benefits managers (PBMs) shall comply with the\n\nfollowing retail pharmacy network access standards:\n\n1. At least ninety percent (90%) of covered individuals\n\nresiding in an urban service area live within two (2) miles of a\n\nretail pharmacy participating in the PBM's retail pharmacy network;\n\n2. At least ninety percent (90%) of covered individuals\n\nresiding in an urban service area live within five (5) miles of a\n\nretail pharmacy designated as a preferred participating pharmacy in\n\nthe PBM's retail pharmacy network;\n\n3. At least ninety percent (90%) of covered individuals\n\nresiding in a suburban service area live within five (5) miles of a\n\nretail pharmacy participating in the PBM's retail pharmacy network;\n\n4. At least ninety percent (90%) of covered individuals\n\nresiding in a suburban service area live within seven (7) miles of a\n\nretail pharmacy designated as a preferred participating pharmacy in\n\nthe PBM's retail pharmacy network;\n\n5. At least seventy percent (70%) of covered individuals\n\nresiding in a rural service area live within fifteen (15) miles of a\n\nretail pharmacy participating in the PBM's retail pharmacy network;\n\nand\n\n6. At least seventy percent (70%) of covered individuals\n\nresiding in a rural service area live within eighteen (18) miles of\n\na retail pharmacy designated as a preferred participating pharmacy\n\nin the PBM's retail pharmacy network.\n\nB. Mail-order pharmacies shall not be used to meet access\n\nstandards for retail pharmacy networks.\n\nC. Pharmacy benefits managers shall not require patients to use\n\npharmacies that are directly or indirectly owned by the pharmacy\n\nbenefits manager, including all regular prescriptions, refills or\n\nspecialty drugs regardless of day supply.\n\nD.
