A health insurer shall be responsible for monitoring all\n\nactivities carried out by, or on behalf of, the health insurer under\n\nthe Patient's Right to Pharmacy Choice Act, and for ensuring that\n\nall requirements of this act are met.\n\nB. Whenever a health insurer contracts with another person to\n\nperform activities required under this act, the health insurer shall\n\nbe responsible for monitoring the activities of that person with\n\nwhom the health insurer contracts and for ensuring that the\n\nrequirements of this act are met.\n\nC. An individual may be notified at the point of sale when the\n\ncash price for the purchase of a prescription drug is less than the\n\nindividual's copayment or coinsurance price for the purchase of the\n\nsame prescription drug.\n\nD. A health insurer or pharmacy benefits manager (PBM) shall\n\nnot restrict an individual's choice of in-network provider for\n\nprescription drugs.\n\nE. An individual's choice of in-network provider may include a\n\nretail pharmacy or a mail-order pharmacy. A health insurer or PBM\n\nshall not restrict such choice. Such health insurer or PBM shall\n\nnot require or incentivize using any discounts in cost-sharing or a\n\nreduction in copay or the number of copays to individuals to receive\n\nprescription drugs from an individual's choice of in-network\n\npharmacy.\n\nF.
