Stat. tit. 36, § 36-6983","heading":"Certificate of authority — Suspension of revocation —","body":"Fines—Hearing.\n\nA. The Insurance Commissioner may suspend or revoke any\n\ncertificate of authority issued pursuant to this act if the\n\nCommissioner finds that the prepaid vision plan organization:\n\n1. Is operating contrary to the basic organizational documents\n\nof the organization or in a manner contrary to that described in or\n\nreasonably inferred from any information submitted pursuant to\n\nSection 6 of this act;\n\n2. Issues a coverage policy which does not comply with the\n\nrequirements of Section 10 of this act;\n\n3. Does not provide or arrange for basic vision services\n\nappropriate to a prepaid vision plan;\n\n4. Can no longer be expected to meet the obligations to\n\nenrollees or prospective enrollees of the prepaid vision plan;\n\n5. Uses fraudulent, coercive, or dishonest practices, or\n\ndemonstrates incompetence, untrustworthiness, or financial\n\nirresponsibility in the conduct of business;\n\n6. Fails to deal equitably with any providers or other persons\n\nor facilities which offer services covered within a contract or\n\npolicy issued pursuant to this act; or\n\n7. Fails to substantially comply with the insurance laws of\n\nthis state or violates any regulation, rule, subpoena, or order of\n\nthe Commissioner.\n\nB. When the certificate of authority of a prepaid vision plan\n\norganization is suspended, the organization shall not accept, during\n\nthe period of such suspension, any additional enrollments for\n\ncoverage except newly acquired dependents of existing enrollees and\n\nshall not engage in any advertising or solicitation.\n\nC. When the certificate of authority of a prepaid vision plan\n\norganization is revoked, the organization shall terminate operation\n\nof the organization in this state immediately and shall conduct no\n\nfurther business except as may be essential to the orderly\n\nconclusion of the business affairs of the organization. The\n\nCommissioner, by written order, may permit further operation of the\n\norganization as the Commissioner finds to be in the best interest of\n\nmembers of the organization.\n\nD. In addition to or in lieu of any applicable suspension or\n\nrevocation of a certificate of authority, the Commissioner may\n\ninvoke a fine not to exceed One Thousand Dollars ($1,000.00) for\n\neach violation. The payment of the fine may be enforced in the same\n\nmanner as civil judgments may be enforced.\n\nE. A prepaid vision plan organization which has had its\n\ncertificate of authority denied, suspended, or revoked, or has\n\nsuffered an adverse determination by the Commissioner shall be\n\nentitled to a hearing pursuant to the provisions of the\n\nAdministrative Procedures Act under Section 250 et seq. of Title 75\n\nof the Oklahoma Statutes.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"218463063422c8140ce837dbd210bc23361f3fe52b50ea7f2e21178c192111d1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6982","next":"us-ok/okla.-stat.-tit.-36-36-6984"},"notice":"GroundRules: Original legal text.
