Stat. tit. 36, § 36-7102","heading":"Definitions","body":"As used in the Perpetual Care Fund Act:\n\n1. \"Cemetery\" or \"cemeteries\" means any land or structure in\n\nthis state dedicated to or used, or intended to be used, for the\n\ninterment of human remains;\n\n2. \"Burial space\" means any grave space, lot, mausoleum crypt\n\nor niche, whether above or below ground, which is used or intended\n\nto be used for the interment of human remains;\n\n3. \"Purchase price\" means the gross dollar amount the customer\n\nshall pay the cemetery under a contractual agreement between the two\n\nto exchange ownership of, or rights to, certain burial spaces.\n\nPurchase price shall not include finance charges, sales tax, charges\n\nfor credit life insurance, opening and closing costs and setting\n\nfees, but shall include any amount which the customer is required to\n\npay as a deposit to the Perpetual Care Fund, described in Section\n\n7103 of this title. On sales of burial spaces wherein discounts or\n\nfree spaces are granted to the customer by the cemetery, the\n\npurchase price shall be the fair market value or the normal selling\n\nprice of that particular type of burial space as sold by the\n\ncemetery;\n\n4. \"Financial institution\" means a federally insured bank or\n\nsavings and loan authorized to exercise trust powers or a trust\n\ncompany that is authorized to do business in this state;\n\n5. \"Income\", except as provided in subsection D of Section 7103\n\nof this title, means the return derived from the principal amount,\n\nexcluding capital gains;\n\n6. \"Insurance Commissioner\" or \"Commissioner\" means the\n\nInsurance Commissioner of the State of Oklahoma; and\n\n7. \"Designated agent\" means one or more individuals designated\n\nby the cemetery owner and whom the owner has acknowledged as having\n\nfiduciary responsibilities under the Perpetual Care Fund Act.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"393866f0ab7a6e9d9c66524e594a31f8f99e89c311506eeffda76ed3cd2026de","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-7101","next":"us-ok/okla.-stat.-tit.-36-36-7103"},"notice":"GroundRules: Original legal text.
