Stat. tit. 36, § 36-7122","heading":"Definitions","body":"As used in the Cemetery Merchandise Trust Act:\n\n1. \"Cemetery merchandise\" means markers, memorials, vases,\n\nmemorial vases, monuments, equipment, crypts, niches or outer\n\nenclosures. Cemetery merchandise shall not include the sale of\n\nlands or interests therein as grave lots or grave spaces; burial or\n\ninterment rights; and delivered or installed crypts, niches or outer\n\nenclosures;\n\n2. \"Purchase price\" means the gross amount to be paid for\n\ncemetery merchandise under the provisions of a prepaid cemetery\n\nmerchandise contract. Purchase price shall not include finance\n\ncharges, sales tax, charges for real property interests or charges\n\nfor credit life insurance;\n\n3. \"Prepaid cemetery merchandise contract\" means any agreement\n\nfor the sale of cemetery merchandise by an organization which\n\nrequires payment of the purchase price, in whole or in part, prior\n\nto delivery of the cemetery merchandise, which agreement is entered\n\ninto from and after November 1, 1989;\n\n4. \"Minimum funding requirement\" means that portion of the\n\npurchase price equal to one hundred ten percent (110%) of the\n\nwholesale cost, plus delivery charges, of the cemetery merchandise\n\ncovered in a prepaid cemetery merchandise contract;\n\n5. \"Organization\" means any individual, firm, partnership,\n\ntrust, corporation, association or entity. Organization shall not\n\ninclude state, county, municipal, township, rural community,\n\nreligious, fraternal or nonprofit entities, free community burial\n\ngrounds, county cemetery associations, Indian tribal cemeteries on\n\ntribal land and charitable or eleemosynary institutions operating\n\ncemeteries in this state;\n\n6. \"Outer enclosure\" means a grave liner, grave box, or grave\n\nvault;\n\n7. \"Lawn crypt\" means a subsurface permanent outer enclosure\n\ninstalled before need in multiple units for the purpose of interring\n\nhuman remains;\n\n8. \"Financial institution\" means a federally insured bank,\n\ntrust company, or savings and loan association which is authorized\n\nto do business in this state;\n\n9. \"Commissioner\" or “Insurance Commissioner” means the\n\nInsurance Commissioner of the State of Oklahoma; and\n\n10. “Wholesale cost” means an amount determined on the basis of\n\nsuch standard quotations and price lists as are published by the\n\nvendor of the cemetery merchandise, without regard to any discounts\n\nthat may be available to the organization.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a81d61332e0440de10884d0f437a2a77f38e0f43114338fd5359c363884927a2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-7121","next":"us-ok/okla.-stat.-tit.-36-36-7123"},"notice":"GroundRules: Original legal text.
