Any organization which shall accept money or anything of\n\nvalue for cemetery merchandise pursuant to a prepaid cemetery\n\nmerchandise contract shall first obtain a permit from the Insurance\n\nCommissioner authorizing the transaction of this type of business\n\nbefore entering into the contract. It shall be unlawful to sell any\n\nprepaid cemetery merchandise unless the organization holds a valid,\n\ncurrent permit at the time the contract is made. The organization\n\nshall not be entitled to enforce a contract made in violation of the\n\nCemetery Merchandise Trust Act, but the purchaser, or the heirs or\n\nlegal representative of the purchaser, shall be entitled to recover\n\ntriple the amounts paid to the organization with interest thereon at\n\nthe rate of six percent (6%) per annum under any contract made in\n\nviolation of this act.\n\nB. An organization with any prepaid cemetery merchandise\n\ncontracts subject to the provisions of the Cemetery Merchandise\n\nTrust Act shall apply for, and obtain, approval of the Commissioner\n\nbefore transferring or conveying in any manner the cemetery, its\n\nobligations or both the cemetery and its obligations under the\n\nprepaid cemetery merchandise contracts. The application shall be\n\naccompanied by a fee equal to that required under Section 7125 of\n\nthis title and shall include such information as the Commissioner\n\nmay prescribe. The Commissioner shall not approve any such transfer\n\nor conveyance until the applicant has provided sufficient evidence\n\nthat a cemetery merchandise trust fund equal to the minimum funding\n\nrequirement is maintained pursuant to Section 7126 of this title or\n\nthe applicant has obtained a surety bond pursuant to the provisions\n\nof Section 7127 of this title.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f26a6fba94a1d1071b36b872701f3d8542dc662b9a50c6388cc03c78903cf2b0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-7122","next":"us-ok/okla.-stat.-tit.-36-36-7124"},"notice":"GroundRules: Original legal text.
