Stat. tit. 36, § 36-7125","heading":"Application for permit - Cancellation of or refusal to","body":"issue or renew permit - Appeal.\n\nA. Each organization desiring to accept money or anything of\n\nvalue for prepaid cemetery merchandise shall file an application for\n\na permit with the Insurance Commissioner, and shall at the time of\n\nfiling the application pay one initial filing fee of Two Hundred\n\nDollars ($200.00). All applications shall be filed electronically\n\nin the manner and form prescribed by the Commissioner, along with\n\nany applicable transaction or other fees. The Commissioner may\n\nissue a permit upon the receipt of the application, the annual\n\nreport in accordance with Section 7128 of this title and payment of\n\nthe filing fees, and upon making a finding that the applicant has\n\ncomplied with the Cemetery Merchandise Trust Act and the rules as\n\nmay be established pursuant to the Cemetery Merchandise Trust Act by\n\nthe Commissioner. All applications shall be signed by the\n\norganization requesting the permit, and shall contain a statement\n\nthat the applicant will comply with all the requirements as\n\nestablished pursuant to the Cemetery Merchandise Trust Act. All\n\npermits shall expire on March 15 of the year following the year the\n\npermit is first issued, unless renewed. Permits may be renewed for\n\na period not to exceed the succeeding March 15 upon the payment of a\n\nrenewal fee of Two Hundred Dollars ($200.00). Any permit expired\n\nfor failure to submit a renewal application may be reinstated within\n\nninety (90) days after the expiration date by electronically\n\nsubmitting a fee in an amount that is double the renewal fee and a\n\nrenewal application in the form and manner prescribed by the\n\nInsurance Commissioner, along with any transaction or other\n\napplicable fees. The Insurance Commissioner shall require a permit\n\nholder whose permit has been expired for more than ninety (90) days\n\nto reapply as if they were a new applicant and pay an application\n\nfee equal to an amount that is double the renewal fee in addition to\n\nany fines imposed. All applications received after the permit has\n\nbeen expired for more than ninety (90) days shall include a detailed\n\nreport of services provided in this state during the period of\n\nexpired permit.\n\nB. The Commissioner may suspend, revoke, refuse to issue, or\n\nrefuse to renew a permit for failure to comply with any provisions\n\nof the Cemetery Merchandise Trust Act or any rules promulgated\n\nthereto by the Commissioner, after reasonable notice to the\n\npermittee and opportunity for hearing before the Commissioner in\n\naccordance with Article II of the Administrative Procedures Act.\n\nC. No organization shall be entitled to a permit after\n\nrevocation, or refusal by the Commissioner to renew a permit, but\n\nmay thereafter be issued a permit upon satisfactory proof of\n\ncompliance with the Cemetery Merchandise Trust Act and the rules\n\npromulgated thereto.\n\nD. An organization aggrieved by the actions of the Commissioner\n\nmay appeal therefrom to the Oklahoma Insurance Department as\n\nprovided by the Administrative Procedures Act.\n\nE. Each permit holder shall electronically submit, in a form\n\nand manner prescribed by the Insurance Commissioner, along with any\n\napplicable fees, any change of legal business name, dba or assumed\n\nname, address, or email address within thirty (30) days after the\n\nchange occurred. Any submission of a change of legal business name,\n\ndba or assumed name, address, or contact eemail address received\n\nmore than thirty (30) days after the change occurred shall be\n\naccompanied by a fee of Fifty Dollars ($50.00).\n\nF.
