There is hereby created a mechanism of funding through\n\nhealth carrier access payments, as defined in Section 7201 of this\n\ntitle, in order to stabilize the state's Medicaid program.\n\nB. There is hereby created in the State Treasury a revolving\n\nfund for the Oklahoma Health Care Authority to be designated the\n\n\"Health Carrier Access Payment Revolving Fund\". The revolving fund\n\nshall be used to fund the state's Medicaid program and make full use\n\nof any federal matching funds available to the state.\n\n1. The revolving fund shall consist of all monies collected and\n\nreceived by the Insurance Commissioner pursuant to Sections 7203 and\n\n7204 of this title, which shall be deposited by the Insurance\n\nCommissioner into the revolving fund, as well as interest\n\nattributable to investment of money in the fund.\n\n2. The revolving fund shall be a continuing fund, not subject\n\nto fiscal year limitations. All monies accruing to the credit of\n\nsaid fund are hereby appropriated and may be budgeted and expended\n\nby the Oklahoma Health Care Authority. Expenditures from the\n\nrevolving fund shall be made pursuant to the laws of this state and\n\nthe statutes relating to the state's Medicaid program. Expenditures\n\nfrom the revolving fund shall be made upon warrants issued by the\n\nState Treasurer, based on claims filed as prescribed by law with the\n\nDirector of the Office of Management and Enterprise Services for\n\napproval and payment.\n\nC. All monies collected under Sections 7203 and 7204 of this\n\ntitle shall be used and expended by the Oklahoma Health Care\n\nAuthority for the support of the state's Medicaid program and make\n\nfull use of any federal matching funds available to the state.\n\nD. The Oklahoma Health Care Authority is hereby authorized to\n\ntransfer funds from the Health Carrier Access Payment Revolving Fund\n\nto the 340 CMIA Programs Disbursing Fund administered by the\n\nOklahoma Health Care Authority for the purpose of carrying out the\n\nprovisions of this act.\n\nE. No monies collected from health carriers as access payments\n\nshall be expended for any wage or salary of any employee of any\n\nstate agency and shall not provide any general or administrative\n\nfunding for the state or any of its agencies, except for reasonable\n\nexpenses incurred by the Insurance Commissioner for the express\n\npurpose of collecting the funds and by the Oklahoma Health Care\n\nAuthority for the express purposes and administration of the fund.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1bb720594f3d773d8e39763c194e8deac2908e1a45f87260a7774c3c3586a16e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-7201","next":"us-ok/okla.-stat.-tit.-36-36-7203"},"notice":"GroundRules: Original legal text.
