Except as provided in subsection B of this section, the\n\naccess payments required to be paid by health carriers in Section 3\n\nof this act shall be due and reported to the Insurance Commissioner\n\non claims paid and incurred beginning July 1, 2010.\n\nB. The access payments required in Section 3 of this act by a\n\nhealth carrier that is a third-party administrator or a self-insured\n\nemployer shall be reported and paid on the basis of claims incurred\n\nand paid beginning July 1, 2010.\n\nC. Access payments shall be made monthly to the Insurance\n\nCommissioner and are due thirty (30) days after the end of each\n\nmonth, except that access payments for third-party administrators\n\nfor groups of fifty or fewer members may be made annually not less\n\nthan sixty (60) days after the close of the plan year.\n\nD. All monies collected by the Insurance Commissioner pursuant\n\nto this act shall be paid into the State Treasury weekly and\n\ntransferred monthly to the Health Carrier Access Payment Revolving\n\nFund created in Section 2 of this act.\n\nE. The Insurance Commissioner may refuse to renew, suspend or\n\nrevoke, after notice and hearing, the certificate of authority to\n\ntransact insurance in this state of any health carrier failing to\n\npay an access payment. In addition to failing to renew, suspension\n\nor revocation of the certificate of authority, the Insurance\n\nCommissioner may assess civil penalties in accordance with Section\n\n619 of Title 36 of the Oklahoma Statutes against any health carrier\n\nfailing to pay an access payment or may take any other enforcement\n\naction authorized by the Oklahoma Insurance Code to collect any\n\nunpaid access payments.\n\nF. Reasonable attorney fees shall be awarded to the Insurance\n\nCommissioner if judicial action is necessary for the enforcement of\n\nthis act. Attorney fees shall be based upon those prevailing in the\n\ncommunity. Attorney fees collected by the Insurance Commissioner\n\nwithout the assistance of the Attorney General shall be credited to\n\nthe State Insurance Commissioner Revolving Fund.\n\nG.
