As used in this section:\n\n1. \"Contracting entity\" means any person or entity that is\n\nengaged in the act of contracting with providers for the delivery of\n\ndental services or the selling or assigning of dental plans to other\n\ndental care entities;\n\n2. \"Identify\" means providing in writing, by email or\n\notherwise, to the participating provider the name, address and\n\ntelephone number, to the extent possible, for any third party to\n\nwhich the contracting entity has granted access to the dental\n\nservices of the participating provider;\n\n3. \"Network plan\" means dental plans offered by a health\n\ninsurance issuer under which the financing and delivery of dental\n\nservices are provided in whole or in part through a defined set of\n\nparticipating providers under contract with the health insurance\n\nissuer;\n\n4. \"Participating provider\" means a provider who, under a\n\ncontract with a contracting entity, has agreed to provide dental\n\nservices with an expectation of receiving payment, other than\n\ncoinsurance, copayments or deductibles, directly or indirectly, from\n\nthe contracting entity; and\n\n5. \"Provider\" means any person licensed by the Board of\n\nDentistry pursuant to the provisions of Section 328.21 of Title 59\n\nof the Oklahoma Statutes.\n\nB. A contracting entity shall not sell, assign or otherwise\n\ngrant access to the dental services of a participating provider\n\nunder any health care contract unless expressly authorized by the\n\nhealth care contract. The health care contract shall specifically\n\nprovide that one purpose of the contract is the selling, assigning\n\nor giving the contracting entity rights to the services of the\n\nparticipating provider, including network plans.\n\nC. Upon entering a contract with a participating provider and\n\nupon request by a participating provider, a contracting entity shall\n\nproperly identify any third party that has been granted access to\n\nthe dental services of the participating provider.\n\nD. A contracting entity that sells, assigns or otherwise grants\n\naccess to the dental services of a participating provider shall\n\nmaintain an Internet website or a toll-free telephone number through\n\nwhich the participating provider may obtain information which\n\nidentifies the insurance carrier to be used to reimburse the\n\nparticipating provider for the covered dental services.\n\nE. A contracting entity that sells, assigns or otherwise grants\n\naccess to a participating provider's dental services shall ensure\n\nthat an explanation of benefits or remittance advice furnished to\n\nthe participating provider that delivers dental services under the\n\nhealth care contract identifies the contractual source of any\n\napplicable discount.\n\nF. All third parties that have contracted with a contracting\n\nentity to purchase, be assigned or otherwise be granted access to\n\nthe participating provider's discounted rate shall comply with the\n\nparticipating provider's contract, including all requirements to\n\nencourage access to the participating provider, and pay the\n\nparticipating provider pursuant to the rates of payment and\n\nmethodology set forth in that contract, unless otherwise agreed to\n\nby a participating provider.\n\nG.
