Stat. tit. 36, § 36-902.2","heading":"Factors for review of filing - Weight - Prohibited","body":"expenses.\n\nA. The Insurance Commissioner when reviewing a filing shall\n\ngive due consideration to the following when, in its discretion, it\n\ndetermines that such factor or factors are applicable:\n\n1. Past loss experience within and outside this state;\n\n2. Prospective loss experience within and outside this state;\n\n3. Physical hazards insured;\n\n4. Safety and loss prevention programs;\n\n5. Underwriting practices and judgment;\n\n6. Catastrophe hazards;\n\n7. Reasonable underwriting profit and contingencies;\n\n8. Dividends, savings or unabsorbed premium deposits allowed or\n\nreturned to policyholders;\n\n9. Past expenses within and outside this state;\n\n10. Prospective expenses within and outside this state;\n\n11. Existence of classification rates for a given risk;\n\n12. Investment income within and outside this state;\n\n13. Rarity or peculiarity of the risks within and outside this\n\nstate;\n\n14. In the case of workers' compensation rates, differences in\n\nthe hazard levels of different geographical regions of the state;\n\n15. All other relevant factors within and outside this state;\n\nand\n\n16. Whether existing rates continue to meet the standards of\n\nthis article.\n\nB. The Commissioner shall determine the weight to be accorded\n\neach of the factors contained in subsection A of this section.\n\nC. Past or prospective expenses within or outside this state\n\npursuant to paragraphs 9 and 10 of subsection A of this section\n\nshall not include prohibited expenses for advertising or prohibited\n\nexpenses for membership in organizations.\n\nFor the purpose of this subsection:\n\n1. “Prohibited expenses for advertising\" means the cost of\n\nadvertising in any media the purpose of which is to influence\n\nlegislation or to advocate support for or opposition to a candidate\n\nfor public office;\n\n2. “Prohibited expenses for advertising\" shall not mean:\n\na. any communication to customers and the public of\n\ninformation regarding an insurer's insurance products,\n\nb. any communication to customers and the public of\n\nsafety, safety education or loss prevention\n\ninformation,\n\nc. periodic publications or reports to stockholders or\n\nmembers required by the certificate or bylaws of the\n\ninsurer,\n\nd. any communication with customers and the public which\n\nprovides instruction in the use of the insurer's\n\nproducts and services, or\n\ne. any communication with customers and the public for\n\ngiving notice or information required by law or\n\notherwise necessary;\n\n3. “Prohibited expenses for membership\" means the cost of\n\nmembership in any organization which conducts substantial efforts,\n\nincluding but not limited to prohibited expenses for advertising,\n\nthe purpose of which is to influence legislation or to advocate\n\nsupport for or opposition to a candidate for public office; and\n\n4. “Prohibited expenses for membership\" shall not mean the cost\n\nof membership in advisory organizations or other organizations the\n\nprimary purpose of which is to provide statistical information on\n\nlosses.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5f0c540d05adbb21410b42d29fbcab766c91853a06f8ba7ae07ce746f9016b5c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-902","next":"us-ok/okla.-stat.-tit.-36-36-903.2"},"notice":"GroundRules: Original legal text.
