The Insurance Commissioner shall monitor and examine the\n\nadequacy of rates of any insurer and advisory organization in this\n\nstate. In so doing, the Commissioner shall:\n\n1. Utilize existing relevant information, analytical systems\n\nand other sources; or\n\n2. Cause or participate in the development of new relevant\n\ninformation, analytical systems and other sources.\n\nB. The Commissioner may require the maintenance and submission\n\nof records, memoranda or information relating to rates from such\n\ninsurers and advisory organizations. The Commissioner or any\n\nauthorized representative of the Commissioner may examine any such\n\nrecord, memoranda or information concerning rates. The application\n\nfor the acceptance of any license or permit issued pursuant to the\n\nprovision of this title shall be deemed consent for the inspection\n\nand examination of such records, memoranda or information.\n\nC. The Commissioner shall conduct such monitoring and\n\nexamination required pursuant to this section within the Insurance\n\nDepartment, at the place of business of such insurers and advisory\n\norganizations, in cooperation with other state insurance\n\ndepartments, through outside contractors or in any other appropriate\n\nmanner.\n\nD. The cost of such examination and monitoring shall be\n\nassessed against insurers and advisory organizations on an equitable\n\nand practical basis established, after hearing, in a rule\n\npromulgated by the Commissioner.\n\nE.
