Stat. tit. 36, § 36-924.2","heading":"Rating plans for workers' compensation self-insureds -","body":"Reduced premium charges for successful participation in occupational\n\nsafety and health programs - Qualification - Certificate - Records.\n\nA. Any rate, schedule of rates or rating plan for workers'\n\ncompensation insurance submitted to or filed with the Insurance\n\nCommissioner, or fixed by the Board of Directors of CompSource\n\nMutual Insurance Company, and premiums, by whatever name, for\n\nworkers' compensation for self-insureds except for group self-\n\ninsured associations shall provide for an appropriate reduction in\n\npremium charges, by whatever name, for those eligible insured\n\nemployers who have successfully participated in the occupational\n\nsafety and health consultation, education and training program\n\nadministered by the Commissioner of the Department of Labor pursuant\n\nto Section 414 of Title 40 of the Oklahoma Statutes.\n\nB. All insurance companies writing workers' compensation\n\ninsurance in this state and all self-insureds providing workers'\n\ncompensation insurance except for group self-insured associations,\n\nshall allow an appropriate reduction in premium charges to all\n\neligible employers who qualify for the reduction pursuant to the\n\nprovisions of this section.\n\nC. Eligible employers shall be those employers:\n\n1. Who are insured by an insurance company writing workers'\n\ncompensation insurance in this state; or\n\n2. Who are self-insured.\n\nD. In order to qualify for the reduction in workers'\n\ncompensation insurance premium, an employer shall successfully\n\nparticipate annually in the occupational safety and health\n\nconsultation, education and training program administered by the\n\nDepartment of Labor. Successful participation shall be defined as:\n\n1. Undergoing a safety and health hazard survey of the\n\nworkplace, including an evaluation of the employer's safety and\n\nhealth program and onsite interviews with employees by the\n\nDepartment's consultant;\n\n2. Correcting all hazards identified during the onsite visit\n\nwithin a reasonable period of time as established by the Department;\n\n3. Establishing an effective workplace safety and health\n\nprogram and implementing program provisions within a reasonable\n\nperiod of time as established by the Department. The program shall\n\ninclude:\n\na. demonstration of management commitment to worker\n\nsafety and health,\n\nb. procedures for identifying and controlling workplace\n\nhazards,\n\nc. development and communication of safety plans, rules\n\nand work procedures, and\n\nd. training for supervisors and employees in safe and\n\nhealthful work practices;\n\n4. Reducing by one-third (1/3) or more the extent to which the\n\nlost workday case rate, as measured by the Department of Labor, was\n\nabove the national average for the industry at the time the employer\n\nelected to participate in the occupational safety and health\n\nconsultation, education and training program, or maintaining a rate\n\nat or below the national average for the industry; and\n\n5. Documenting a reduction in workers' compensation claims for\n\nthe preceding year by showing one of the following:\n\na. a ten percent (10%) reduction in the dollar amount of\n\nclaims,\n\nb. a ten percent (10%) reduction in the severity of\n\nclaims, or\n\nc. no reported claims,\n\nas a result of attending the occupational safety and health\n\nconsultation, education and training program administered by the\n\nDepartment of Labor.\n\nE. 1. Upon successful participation in the occupational safety\n\nand health consultation, education and training program as defined\n\nin subsection D of this section, an employer shall be issued a\n\ncertificate by the Commissioner of the Department of Labor which\n\nshall be the basis of qualification for the reduction in workers'\n\ncompensation insurance premium, by whatever name. The certificate\n\nshall qualify the employer for a premium reduction for a one-year\n\nperiod.\n\n2. Upon issuance of a certificate to an employer, the\n\nCommissioner of the Department of Labor shall mail a copy of the\nd a\n\ncertificate by the Commissioner of the Department of Labor which\n\nshall be the basis of qualification for the reduction in workers'\n\ncompensation insurance premium, by whatever name. The certificate\n\nshall qualify the employer for a premium reduction for a one-year\n\nperiod.\n\n2. Upon issuance of a certificate to an employer, the\n\nCommissioner of the Department of Labor shall mail a copy of the\n\ncertificate to the employer's insurer. Any insurer required by this\n\nsection to allow an appropriate reduction in premium charges to a\n\nqualified employer which willfully fails to allow such reduction\n\nafter receiving a copy of the certificate shall be subject, after\n\nnotice and hearing, to an administrative fine, imposed by the\n\nInsurance Commissioner, which shall be not less than Ten Thousand\n\nDollars ($10,000.00) or three times the amount of the premium\n\nreduction, whichever is greater. The Insurance Commissioner shall\n\npromulgate rules necessary to carry out the provisions of this\n\nparagraph.\n\nF. The Insurance Commissioner and the Administrator of the\n\nWorkers' Compensation Court shall maintain records documenting\n\nreductions in workers' compensation insurance premiums granted\n\npursuant to this section and shall make an annual report of such\n\nreductions to the President Pro Tempore of the Senate and the\n\nSpeaker of the House of Representatives by May 1 of each year.\n\nInsurers shall report such premium reductions in their annual\n\nstatement.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bf2e89ec67b54f7c24fefeee175d10940eba5adfa8995f3eb827ce29da0505ad","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-924.1","next":"us-ok/okla.-stat.-tit.-36-36-924.3"},"notice":"GroundRules: Original legal text.
