Stat. tit. 36, § 36-952","heading":"Definitions","body":"As used in this act:\n\n1. “Adverse action” means a denial or cancellation of, an\n\nincrease in any charge for, or a reduction or other adverse or\n\nunfavorable change in the terms of coverage or amount of, any\n\ninsurance, existing or applied for, in connection with the\n\nunderwriting of personal insurance;\n\n2. “Affiliate” means any company that controls, is controlled\n\nby, or is under common control with another company;\n\n3. “Applicant” means an individual who has applied to be\n\ncovered by a personal insurance policy with an insurer;\n\n4. “Consumer” means an insured whose credit information is used\n\nor whose insurance score is calculated in the underwriting or rating\n\nof a personal insurance policy or an applicant for such a policy;\n\n5. “Consumer reporting agency” means any person which, for\n\nmonetary fees, dues, or on a cooperative nonprofit basis, regularly\n\nengages in whole or in part in the practice of assembling or\n\nevaluating consumer credit information or other information on\n\nconsumers for the purpose of furnishing consumer reports to third\n\nparties;\n\n6. “Credit information” means any credit-related information\n\nderived from a credit report, found on a credit report itself, or\n\nprovided on an application for personal insurance. Information that\n\nis not credit-related shall not be considered \"credit information”,\n\nregardless of whether it is contained in a credit report or in an\n\napplication, or is used to calculate an insurance score;\n\n7. “Credit report” means any written, oral, or other\n\ncommunication of information by a consumer reporting agency bearing\n\non a consumer’s credit worthiness, credit standing or credit\n\ncapacity which is used or expected to be used or collected in whole\n\nor in part for the purpose of serving as a factor to determine\n\npersonal insurance premiums, eligibility for coverage, or tier\n\nplacement;\n\n8. “Insurance score” means a number or rating that is derived\n\nfrom an algorithm, computer application, model, or other process\n\nthat is based in whole or in part on credit information for the\n\npurposes of predicting the future insurance loss exposure of an\n\nindividual applicant or insured; and\n\n9. “Personal insurance” means private passenger automobile,\n\nhomeowners, motorcycle, mobile-homeowners and noncommercial dwelling\n\nfire insurance policies and boat, personal watercraft, snowmobile\n\nand recreational vehicle policies. Such policies must be\n\nindividually underwritten for personal, family or household use.
