Stat. tit. 36, § 36-953.1","heading":"Exceptions by insurers to certain events influencing","body":"credit information – Request by insured or applicant.\n\nA. Notwithstanding any other law or regulation, an insurer that\n\nuses credit information shall, upon written request from an\n\napplicant for insurance coverage or an insured upon a form provided\n\nby the Insurance Commissioner, provide reasonable exceptions to the\n\nrate of the insurer, rating classifications, company or tier\n\nplacement or underwriting rules or guidelines for a consumer who has\n\nexperienced and whose credit information has been directly\n\ninfluenced by any of the following events:\n\n1. Catastrophic event declared by the federal or state\n\ngovernment;\n\n2. Serious illness or injury, or serious illness or injury to\n\nan immediate family member;\n\n3. Death of an immediate family member;\n\n4. Divorce or involuntary interruption of legally owed alimony\n\nor support payments;\n\n5. Identity theft;\n\n6. Temporary loss of employment for a period of three (3)\n\nmonths or more, if it results from involuntary termination;\n\n7. Military deployment overseas; and\n\n8. Other events, as determined by the Insurance Commissioner.\n\nB. If an applicant or insured submits a request for an\n\nexception as provided in subsection A of this section, an insurer\n\nmay, in its sole discretion:\n\n1. Require the consumer to provide reasonable written and\n\nindependently verifiable documentation of the event;\n\n2. Require the consumer to demonstrate that the event had\n\ndirect and meaningful impact on the credit information of the\n\nconsumer;\n\n3. Require the request be made no more than sixty (60) days\n\nfrom the date of the application for insurance or the policy\n\nrenewal;\n\n4. Grant an exception despite the consumer not providing the\n\ninitial request for an exception in writing; or\n\n5. Grant an exception to requiring a written request where the\n\nconsumer asks for a consideration of repeated events or the insurer\n\nhas considered this event previously.\n\nC. An insurer is in compliance with any other provision of law\n\nor Insurance Department rule relating to underwriting, rating or\n\nrate filing notwithstanding the granting an exception under this\n\nsection. Nothing in this section shall be construed to provide a\n\nconsumer or other insured with a cause of action that does not exist\n\nin the absence of this section.\n\nD.
