To be eligible for a grant, residential property owners\n\napplying for a grant must be able to meet the eligibility\n\nrequirements as set forth by the Insurance Department for each grant\n\ntype. These requirements shall include, but not be limited to, the\n\nfollowing:\n\n1. The residential property owner shall have or be constructing\n\ninsurable property, as defined in Section 963 of Title 36 of the\n\nOklahoma Statutes, that has been granted a homestead exemption, or,\n\nif new build, provides other documentation approved by the Insurance\n\nCommissioner;\n\n2. The residential property owner shall claim their primary\n\nresidence in a county where grants are being approved;\n\n3. The home to be mitigated shall be an owner-occupied, single-\n\nfamily, primary residence and cannot be a condominium or mobile\n\nhome;\n\n4. The home shall be in good repair unless damaged by a tornado\n\nor other catastrophic windstorm event or hail. SOH Program grant\n\nfunds cannot be used for maintenance or repairs but may be used in\n\nconjunction with repairs or reconstruction necessitated by damages\n\nfrom a tornado or other catastrophic windstorm event or hail;\n\n5. A Certified IBHS Evaluator shall prequalify the insurable\n\nproperty as mitigable and identify all improvements required to\n\nachieve IBHS FORTIFIED Roof™ (Roof), FORTIFIED Silver™ (Silver),\n\nFORTIFIED Gold™ (Gold), or successor designation, or similar\n\nstandard approved by the Insurance Commissioner. The residential\n\nproperty owner shall select the evaluator from a list provided by\n\nthe SOH Program and shall pay the evaluator's fee;\n\n6. The residential property owner shall obtain bids from at\n\nleast three IBHS Certified Contractors approved by the SOH Program;\n\n7. The residential property owner shall construct or retrofit\n\nthe home to the Insurance IBHS Roof or Silver, Gold, or successor\n\ndesignation or similar standard approved by the Commissioner, which\n\nshall include the hail supplement;\n\n8. The residential property owner shall provide proof of an in-\n\nforce policy providing wind insurance on the home; and\n\n9. If the insurable property is in a special flood hazard area,\n\nthe residential property owner shall provide proof of an in-force\n\nflood insurance policy. The flood policy may be from the National\n\nFlood Insurance Program (NFIP) or a private carrier.\n\nB. Grant applications shall be filed electronically with the\n\nDepartment in the form and manner prescribed by the Commissioner,\n\nalong with any applicable transaction fees.\n\nC. Documents, materials, and other information submitted to the\n\nDepartment by property owners or insurance companies in support of a\n\ngrant application shall be confidential by law and privileged, shall\n\nnot be subject to open records requests, shall not be subject to\n\nsubpoena, and shall not be subject to discovery or admissible in\n\nevidence in any private civil action.\n\nD. Grants to residential property owners shall be used to\n\nconstruct or retrofit an insurable property as defined in Section\n\n963 of Title 36 of the Oklahoma Statutes to resist loss due to a\n\ntornado or other catastrophic windstorm event or hail as prescribed\n\nin subsection B of Section 962 of Title 36 of the Oklahoma Statutes.\n\nE. Retrofit projects within six (6) months of the date the\n\nresidential property owner receives notice of the grant approval.\n\nNew builds shall be completed within the timeframe approved by the\n\nCommissioner. Failure to complete the project timely may result in\n\nforfeiture of the grant.\n\nF. Grant funds shall only be paid once a certificate has been\n\nissued for the fortified standard approved by the Commissioner.\n\nGrant funds shall be paid by the Department or another designated\n\nagency, on behalf of the residential property owner, directly to the\n\ncontractor who performed the mitigation work.\n\nG. Applications will be accepted on a first-come, first-served\n\nbasis within each income tier established by the Commissioner, with\nrtificate has been\n\nissued for the fortified standard approved by the Commissioner.\n\nGrant funds shall be paid by the Department or another designated\n\nagency, on behalf of the residential property owner, directly to the\n\ncontractor who performed the mitigation work.\n\nG. Applications will be accepted on a first-come, first-served\n\nbasis within each income tier established by the Commissioner, with\n\npriority given to lower-income applicants, applicants who live in\n\nlocations that, based on historical data, have a higher\n\nsusceptibility to catastrophic weather events, and applicants\n\nmeeting any other criteria the Commissioner determines is\n\nappropriate to meet the purpose of the program.\n\nH. Any entity providing funds to the SOH Program shall be\n\npermitted to establish additional rules and guidelines under which\n\nthose funds may be used, as long as such rules and guidelines do not\n\nviolate any state or federal law.\n\nI.
