In a competitive market, every insurer shall file with the\n\nCommissioner all rates and supplementary rate information to be used\n\nin this state no later than thirty (30) days after the effective\n\ndate; provided, that the rates and supplementary rate information\n\nneed not be filed for commercial risks, which by general custom are\n\nnot written according to manual rules or rating plans.\n\nB. In a noncompetitive market, every insurer shall file with\n\nthe Commissioner all rates, supplementary rate information and\n\nsupporting information at least thirty (30) days before the proposed\n\neffective date. The Commissioner may give written notice, within\n\nthirty (30) days of receipt of the filing, that the Commissioner\n\nneeds additional time, not to exceed thirty (30) days from the date\n\nof the notice to consider the filing. Upon written application of\n\nthe insurer, the Commissioner may authorize rates to be effective\n\nbefore the expiration of the waiting period or an extension thereof.\n\nA filing shall be deemed to meet the requirements of the Property\n\nand Casualty Competitive Loss Cost Rating Act and to become\n\neffective unless disapproved pursuant to this title by the\n\nCommissioner before the expiration of the waiting period or an\n\nextension thereof.\n\nIn a noncompetitive market, the filing shall be deemed in\n\ncompliance with the filing provision of this section unless the\n\nCommissioner informs the insurer within ten (10) days after receipt\n\nof the filings as to what supplementary rate information or\n\nsupporting information is required to complete the filing.\n\nC. Every authorized insurer shall file with the Commissioner,\n\nexcept as to rates for those lines of insurance exempted from the\n\nprovisions of the Property and Casualty Competitive Loss Cost Rating\n\nAct by the Commissioner under subsections E and F of this section\n\nand except for those risks designated as special risks under Section\n\n997 of this title, all rates, supplementary rate information and any\n\nchanges and amendments which it proposes to use. An insurer may\n\nfile its rates by either filing its final rates or by filing a\n\nmultiplier and, if applicable, an expense constant adjustment to be\n\napplied to prospective loss costs that have been filed by an\n\nadvisory organization as permitted by this title. Such loss cost\n\nmultiplier filing and expense constant filings made by insurers\n\nshall remain in effect until amended or withdrawn by the insurer.\n\nEvery filing shall state the effective date.\n\nD. Under rules as may be adopted, the Commissioner may, by\n\nwritten order, suspend or modify the requirement of filing as to any\n\nkind of insurance, subdivision or combination thereof, or as to\n\nclasses of risks.\n\nE. Notwithstanding any other provision of the Property and\n\nCasualty Competitive Loss Cost Rating Act, upon the written consent\n\nof the insured in a separate written document, a rate in excess of\n\nthat determined in accordance with the other provisions of the\n\nProperty and Casualty Competitive Loss Cost Rating Act may be used\n\non a specific risk.\n\nF. A filing and any supporting information required to be filed\n\nshall be open to public inspection once the filing becomes effective\n\nexcept information marked confidential, trade secret, or proprietary\n\nby the insurer or filer and except the filings of an advisory\n\norganization which shall be open to public inspection upon the\n\nreceived date of the rate, loss cost, or manual rule change. The\n\ninsurer or filer shall have the burden of asserting to the\n\nCommissioner that a filing and supporting information are\n\nconfidential, upon the request of the Commissioner.
