Members of the ABLE Commission shall:\n\n1. Be citizens of the United States;\n\n2. Be qualified electors in this state;\n\n3. Have been residents of this state for at least ten (10)\n\nconsecutive years immediately preceding the date of their\n\nappointment and qualification; and\n\n4. Be persons of outstanding character, experienced, efficient\n\nand successful in business affairs and of good reputation in their\n\ncommunities.\n\nB. Members shall execute the loyalty oath required by law for\n\nelected state officials before assuming the duties of their office.\n\nC. No person shall be appointed who:\n\n1. Has been convicted of, or shall have pleaded guilty to, a\n\nfelony or any violation of any federal or state law concerning the\n\nmanufacture or sale of alcoholic beverages or cereal malt beverages\n\nprior or subsequent to the passage of the Oklahoma Alcoholic\n\nBeverage Control Act;\n\n2. Has paid a fine or penalty in settlement in any prosecution\n\nagainst the person in any violation of such laws; or\n\n3. Shall have forfeited a bond to appear in court to answer\n\ncharges for any such violation.\n\nD. No appointee shall serve if the appointee or any person\n\nrelated to the appointee in the third degree by consanguinity or\n\naffinity is an officer, director, employee or stockholder in any\n\ncorporation or partnership which has as its business the\n\nmanufacture, sale or distribution of an alcoholic beverage.\n\nE. No member of the ABLE Commission shall own, mortgage or\n\nlease any retail or wholesale store or warehouse, any establishment\n\nselling alcoholic beverages by the individual drink for on-premises\n\nconsumption, any establishment operated by a caterer who provides\n\nalcoholic beverages by the individual drink pursuant to a caterer's\n\nlicense or any bottle club as provided in the alcoholic beverage\n\ncontrol laws of this state.\n\nF. The provisions of the Oklahoma Alcoholic Beverage Control\n\nAct shall not prevent any member of the ABLE Commission from\n\npurchasing and possessing, for personal use or use by the members of\n\nthe member's family or any guests, any alcoholic beverage which may\n\nbe purchased or kept by any person by virtue of the provisions of\n\nthe Oklahoma Alcoholic Beverage Control Act.\n\nG. In order to establish the qualifications of members of the\n\nABLE Commission, a national criminal history record check as defined\n\nin Section 150.9 of Title 74 of the Oklahoma Statutes shall be\n\nrequired for each member.\n\nH. A majority of the members of the ABLE Commission shall\n\nconstitute a quorum to transact business, but no vacancy shall\n\nimpair the right of the remaining members to exercise all of the\n\npowers of the Commission, and every act of a majority of the members\n\nshall be deemed to be the act of the ABLE Commission. The ABLE\n\nCommission shall appoint the Director as secretary who shall keep a\n\nrecord of all proceedings and official acts of the Commission and\n\nwho shall be the custodian of all records and perform such other\n\nduties as the ABLE Commission shall prescribe.\n\nI. Each member of the ABLE Commission shall receive\n\nreimbursement for travel expenses incurred in attending meetings as\n\nprovided for in the State Travel Reimbursement Act.\n\nJ. The office of the ABLE Commission shall be in Oklahoma City\n\nin office space provided by the Office of Management and Enterprise\n\nServices. All meetings of the ABLE Commission shall be open to the\n\npublic and all records of the ABLE Commission shall be public\n\nrecords and open for public inspection. The ABLE Commission shall\n\nhold regular meetings at least once a month and may hold such\n\nspecial meetings as it deems necessary at any time and at any place\n\nwithin the state.\n\nK. The ABLE Commission, for authentication of its records,\n\nprocess and proceedings, may adopt, keep and use a common seal, of\n\nwhich seal judicial notice shall be taken in all the courts of the\n\nstate. Any process, notice or other paper which the ABLE Commission\neetings at least once a month and may hold such\n\nspecial meetings as it deems necessary at any time and at any place\n\nwithin the state.\n\nK. The ABLE Commission, for authentication of its records,\n\nprocess and proceedings, may adopt, keep and use a common seal, of\n\nwhich seal judicial notice shall be taken in all the courts of the\n\nstate. Any process, notice or other paper which the ABLE Commission\n\nmay be authorized by law to issue shall be deemed sufficient if\n\nsigned by the secretary of the ABLE Commission and authenticated by\n\nsuch seal. All acts, orders, proceedings, rules, regulations,\n\nentries, minutes and other records of the ABLE Commission, and all\n\nreports and documents filed with the ABLE Commission may be proved\n\nin any court of this state by copy thereof certified by the\n\nsecretary of the ABLE Commission with the seal of the ABLE\n\nCommission attached.\n\nL.
