The ABLE Commission shall appoint a Director, who shall\n\nemploy an Assistant Director and such other personnel as are\n\nnecessary to properly enforce and administer the Oklahoma Alcoholic\n\nBeverage Control Act. The Director shall require bonds in such\n\ninstances and amounts as the ABLE Commission may direct, and shall\n\nbe in direct charge of all records. The Director shall further have\n\nthe following specific powers and duties:\n\n1. To issue licenses provided for in the Oklahoma Alcoholic\n\nBeverage Control Act, and to approve or reject any official bond\n\nrequired to be filed with the Director or the ABLE Commission;\n\n2. To appoint and employ, supervise and discharge such\n\nemployees as may be determined necessary for the proper discharge of\n\nthe duties of the office of Director, upon duties and salary fixed\n\nand determined by the ABLE Commission and subject to all the rules\n\nthat may be promulgated by the ABLE Commission. The Director and\n\nthe ABLE Commission, in appointing and employing personnel, shall\n\ngive preference to honorably discharged members of the Armed Forces\n\nof the United States;\n\n3. To conduct such investigations and make such reports as may\n\nbe necessary to keep the ABLE Commission advised concerning any\n\nviolations of the provisions of the Oklahoma Alcoholic Beverage\n\nControl Act and make orders for its enforcement;\n\n4. To make recommendations to the ABLE Commission concerning\n\nthe suspension or revocation of any licenses, the levying of fines\n\nagainst licensees for violations of the provisions of the Oklahoma\n\nAlcoholic Beverage Control Act or rules of the ABLE Commission or\n\nany action that should be filed or commenced against any official\n\nbond theretofore approved by the Director or the ABLE Commission;\n\n5. To regularly inspect all places of business of licensees,\n\nand all other persons, firms or corporations dealing in the\n\nmanufacture, distribution, transportation, sale or service of\n\nalcoholic beverages under the provisions of the Oklahoma Alcoholic\n\nBeverage Control Act and report to the ABLE Commission concerning\n\nany and all violations with a recommendation to the ABLE Commission\n\nfor its determination;\n\n6. To refer any evidence of a violation of any provision of the\n\nOklahoma Alcoholic Beverage Control Act which carries a criminal\n\npenalty to the appropriate law enforcement authority for action;\n\n7. To aid the enforcement authorities of this state or any\n\ncounty or municipality of the state, or the federal government, in\n\nprosecutions of violations of the Oklahoma Alcoholic Beverage\n\nControl Act;\n\n8. To enforce the provisions of the Prevention of Youth Access\n\nto Tobacco Act including but not limited to the levying of\n\nadministrative fines against persons violating the provisions of the\n\nPrevention of Youth Access to Tobacco Act, and to at least annually\n\nconduct random unannounced inspections at locations where tobacco\n\nproducts are sold or distributed and conduct targeted inspections at\n\nthose locations which have been in violation of the provisions of\n\nthe Prevention of Youth Access to Tobacco Act; and\n\n9. To enter into interagency transfers with the Oklahoma State\n\nBureau of Investigation, the Oklahoma Bureau of Narcotics and\n\nDangerous Drugs and the Oklahoma Highway Patrol as provided for in\n\nSection 1 of this act.\n\nB. The Director may employ or contract with attorneys, as\n\nneeded, to advise the Director and the ABLE Commission on all legal\n\nmatters and shall appear for and represent the Director and the ABLE\n\nCommission in all administrative hearings and all litigation or\n\nother proceedings which may arise in the discharge of their duties.\n\nAt the request of the ABLE Commission, such attorneys shall assist\n\ndistrict attorneys in prosecuting charges of violators of the\n\nOklahoma Alcoholic Beverage Control Act.","path":["OK Code","Title 37A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os37A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4696ce8009ff9b3505932fe6fd9d5ff0024bb1fb77283975ec5d1af8838b1544","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-37a-37a-1-107","next":"us-ok/okla.-stat.-tit.-37a-37a-1-109"},"notice":"GroundRules: Original legal text.
