Stat. tit. 37A, § 37A-1-110","heading":"Restrictions on Commission members and employees –","body":"Penalties.\n\nA. No member or employee of the ABLE Commission shall:\n\n1. Be appointed or serve who has been convicted of a felony or\n\nof any violation of any federal or state law relating to alcoholic\n\nbeverages;\n\n2. Directly or indirectly, individually or as a member of a\n\npartnership, or as a shareholder of a corporation, have any interest\n\nwhatsoever in the manufacture, sale or distribution of alcoholic\n\nbeverages;\n\n3. Receive any compensation or profit therefrom, nor have any\n\ninterest, directly or indirectly, in any business authorized by a\n\nlicense issued pursuant to the provisions of the Oklahoma Alcoholic\n\nBeverage Control Act. The holding of membership or elective or\n\nappointed office in fraternal organizations which obtain licenses\n\nauthorized by the Oklahoma Alcoholic Beverage Control Act shall not\n\nbe considered to be engagement in the alcoholic beverage business;\n\n4. Solicit or accept any gift, gratuity, emolument or\n\nemployment from any person subject to the provisions of the Oklahoma\n\nAlcoholic Beverage Control Act, or from any officer, agent or\n\nemployee thereof;\n\n5. Solicit, request from or recommend, directly or indirectly,\n\nto any such person or to any officer, agent or employee thereof, the\n\nappointment of any person to any place or position, and every such\n\nperson, and every officer, agent or employee thereof, is hereby\n\nforbidden to offer to any member or employee of the ABLE Commission\n\nany gift, gratuity, emolument or employment;\n\n6. Accept employment within the alcoholic beverage industry for\n\nany holder of a license issued pursuant to the provisions of the\n\nOklahoma Alcoholic Beverage Control Act; or\n\n7. Represent, directly or indirectly, any such licensee in any\n\nproceedings before the Director, the ABLE Commission or the Tax\n\nCommission within two (2) years following separation from the ABLE\n\nCommission.\n\nB. Violation of any provision of subsection A of this section\n\nshall constitute a misdemeanor. In addition to the penal\n\nprovisions, any person convicted shall be immediately removed from\n\nthe office or position he or she holds.\n\nC. No license of any kind shall be granted to or retained by\n\nany person or any partnership containing any partner who is related\n\nto any member of the ABLE Commission or to the Director or Assistant\n\nDirector by affinity or consanguinity within the third degree or who\n\nis related to any other employee of the ABLE Commission by affinity\n\nor consanguinity in the first degree. If a license is held in\n\nviolation of the provisions of this subsection, the member or\n\nemployee of the ABLE Commission shall not be entitled to receive any\n\ncompensation or other monies from the State of Oklahoma while a\n\nlicense is held in violation of the provisions of this subsection.\n\nD. It shall be unlawful for any member or employee of the ABLE\n\nCommission to lend, expend or contribute any money, funds, property\n\nor other thing of value, or use his or her official position for the\n\npurpose of securing the nomination or election or the defeat of any\n\ncandidate for public office in the State of Oklahoma.\n\nE. Any person who shall violate the provisions of subsection D\n\nof this section shall, upon conviction, be fined not less than Two\n\nThousand Five Hundred Dollars ($2,500.00) nor more than Five\n\nThousand Dollars ($5,000.00), or be imprisoned in the county jail\n\nfor not more than one (1) year, or by both such fine and\n\nimprisonment.
