Employees of the State of Oklahoma and its political\n\nsubdivisions are hereby permitted to obtain licenses from the ABLE\n\nCommission and to be involved in the alcoholic beverage business\n\nunless such involvement and licensing is prohibited by law.\n\nB. The following officers and employees of the State of\n\nOklahoma and its political subdivisions are hereby prohibited from\n\nengaging in the alcoholic beverage business:\n\n1. All judges, district attorneys, assistant district attorneys\n\nand any public official who sits in a judicial capacity with\n\njurisdiction over the Oklahoma Alcoholic Beverage Control Act;\n\n2. With the exception of those peace officers who are working\n\nas off-duty security, all employees certified as peace officers\n\nengaging in law enforcement activities; and\n\n3. All employees of the Oklahoma Tax Commission who engage in\n\nthe auditing, enforcement and collection of alcoholic beverage\n\ntaxes.\n\nC. The holding of membership or elective or appointed office in\n\nfraternal organizations which obtain mixed beverage or bottle club\n\nlicenses by employees of the state or a political subdivision shall\n\nnot be considered to be engagement in the alcoholic beverage\n\nbusiness.\n\nD. If the voters of a county in which a state lodge is located\n\napprove sale of alcoholic beverages by the individual drink for on-\n\npremises consumption, then such sale of alcoholic beverages on the\n\npremises of such lodge shall be authorized if a license for such\n\nsale, issued pursuant to the provisions of the Oklahoma Alcoholic\n\nBeverage Control Act, is obtained. Provided, further, that a bottle\n\nclub may be licensed on the premises of a state lodge located in a\n\ncounty where sale of alcoholic beverages by the individual drink for\n\non-premises consumption is not authorized.\n\nE. The provisions of subsection D of this section shall not\n\nprohibit the state or a political subdivision of the state from\n\nleasing a public building or facility to a person who obtains a\n\nmixed beverage license, bottle club license, special event license,\n\ncontracts for the services of a licensed caterer or subleases the\n\nbuilding or facility to a person who obtains a mixed beverage\n\nlicense, bottle club license, special event license or contracts for\n\nthe services of a licensed caterer.\n\nF.
