Stat. tit. 37A, § 37A-2-104","heading":"Winemaker license","body":"A winemaker license shall authorize the holder thereof:\n\n1. To manufacture (including such mixing, blending and cellar\n\ntreatment as authorized by federal law), bottle, package and store\n\non licensed premises wine containing not more than twenty-four\n\npercent (24%) alcohol by volume, provided the bottle or package\n\nsizes authorized shall be limited to the capacities approved by the\n\nUnited States Alcohol and Tobacco Tax and Trade Bureau;\n\n2. To sell wine in this state to licensed wholesalers and\n\nmanufacturers;\n\n3. To sell wine produced at the winery from grapes and other\n\nfruits and berries grown in this state, if available, for either on-\n\npremises or off-premises consumption to consumers on the premises of\n\nthe winery;\n\n4. To serve free samples of wine produced at the winery to\n\nvisitors twenty-one (21) years of age and older. For purposes of\n\nthis section, no visitor may sample more than a total of six (6)\n\nfluid ounces of wine per day. The winery shall restrict the\n\ndistribution and consumption of wine samples to an area within the\n\nlicensed premises designated by the winery. A current floor plan\n\nthat includes the designated sampling area shall be on file with the\n\nABLE Commission. No visitor under twenty-one (21) years of age\n\nshall be permitted to enter the designated sampling area when\n\nsamples are being distributed and consumed. Samples of wine served\n\nby a winery under this section shall not be considered a sale of\n\nwine within the meaning of Article XXVIII-A of the Oklahoma\n\nConstitution or Section 1-103 of this title; provided, such samples\n\nof wine shall be considered removed or withdrawn from the winery for\n\nuse or consumption within the meaning of Section 5-110 of this title\n\nfor excise tax determination and reporting requirements;\n\n5. To serve free samples of wine produced at the winery at\n\npublic events such as festivals and trade shows;\n\n6. To sell wine produced at the winery, for either on-premises\n\nor off-premises consumption at public events such as festivals and\n\ntrade shows;\n\n7. To sell wine out of this state to qualified persons;\n\n8. To purchase from licensed winemakers, distillers and\n\nrectifiers in this state, and to import into this state wine, brandy\n\nand fruit spirits for use in manufacturing in accordance with\n\nfederal laws and regulations;\n\n9. To sell and serve Oklahoma-manufactured wine, mulled wine,\n\nor spiced wine, mixed with nonalcoholic beverages or food items such\n\nas water, sugar, fruits and vegetables, at any temperature for\n\neither on-premises or off-premises consumption;\n\n10. To purchase beer in retail containers from the holder of a\n\nwholesaler, beer distributor, small brewer self-distributor or\n\nbrewpub self-distributor license or as specifically provided by law;\n\n11. To sell, offer for sale and possess beer for on-premises\n\nconsumption; and\n\n12. To establish satellite tasting rooms as defined and\n\nauthorized in this act where the winemaker's products may be tasted,\n\nsampled, sold and served for on-premises consumption and the\n\nwinemaker is permitted to sell its products in sealed containers;\n\nprovided, the small farm winery license or winemaker license is\n\nactive and in good standing.
