A winemaker self-distribution license shall authorize a\n\nlicensed winemaker within or without this state which is permitted\n\nby Article XXVIIIA of the Oklahoma Constitution and this section:\n\n1. To distribute its wine directly to retail spirits, retail\n\nwine and retail beer licensees, mixed beverage licensees, beer and\n\nwine licensees, and restaurants in this state; and\n\n2. If such a winemaker elects to do so, to sell and deliver its\n\nwines directly to licensed retail package stores, mixed beverage\n\nlicensees, beer and wine licensees, and restaurants in this state in\n\nfull case lots only, and in accordance with the provisions of the\n\nOklahoma Alcoholic Beverage Control Act and such rules as the ABLE\n\nCommission shall promulgate.\n\nB. A winemaker either within or without this state that\n\nannually produces no more than fifteen thousand (15,000) gallons of\n\nwine may elect to sell and self-distribute the wine produced by such\n\nwinemaker directly to licensed retail package stores, mixed beverage\n\nlicensees, beer and wine licensees, and restaurants in this state;\n\nprovided:\n\n1. Any such winemaker which elects to directly sell its wine to\n\npackage stores, mixed beverage licensees, beer and wine licensees,\n\nand restaurants shall not also use a licensed wholesale distributor\n\nas a means of distribution, and shall be required to sell its wines\n\nto every package store, mixed beverage licensee, beer and wine\n\nlicensee, and restaurant licensee who desires to purchase the same,\n\non the same price basis and without discrimination;\n\n2. If a winemaker or winery sells directly to a retail package\n\nstore, mixed beverage licensee, beer and wine licensee or\n\nrestaurant, the winemaker shall transport the wine from the\n\nwinemaker's winery to the premises where the wine is to be delivered\n\nonly in vehicles owned or leased by the winemaker and not by common\n\nor private contract carrier and shall obtain all necessary permits\n\nas required by the Oklahoma Alcoholic Beverage Control Act; and\n\n3. If the production volume limit applicable to winemakers is\n\nruled to be unconstitutional by a court of competent jurisdiction,\n\nthen no winemaker shall be permitted to directly sell its wine to\n\nretail package stores, non-package-store retailers, mixed beverage\n\nlicensees, beer and wine licensees or restaurants in this state.","path":["OK Code","Title 37A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os37A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"394dc3fd3dcc58c064b168b7816b333ff50062ed94780f74e9e01874bb4d76b5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-37a-37a-2-104","next":"us-ok/okla.-stat.-tit.-37a-37a-2-106"},"notice":"GroundRules: Original legal text.
