An on-premises beer and wine license shall authorize the\n\nholder thereof:\n\n1. To purchase beer and wine in retail containers from the\n\nholder of a wholesaler, beer distributor, small brewer self-\n\ndistribution or brewpub self-distribution license or as specifically\n\nprovided by law. The holder of an on-premises beer and wine license\n\nissued for an establishment which is also a restaurant may purchase\n\nwine from a winemaker who is permitted and has elected to self-\n\ndistribute as provided in Article XXVIII-A of the Oklahoma\n\nConstitution; and\n\n2. To sell, offer for sale and possess beer and wine for on-\n\npremises consumption only; provided, an on-premises beer and wine\n\nlicensee may sell beer and wine for off-premises consumption if it\n\nmeets the classification of a golf course, country club, or marina\n\npursuant to subsection C of this section. The mixed beverage\n\nlicensee shall be permitted to sell beer and wine for off-premises\n\nconsumption during all days and hours in which a retail beer\n\nlicensee or retail wine licensee is permitted to sell beer or wine.\n\nThe gross receipts tax set forth in Section 5-105 of this title\n\nshall apply to all alcoholic beverages sold by the on-premises beer\n\nand wine licensee, whether those alcoholic beverages are intended\n\nfor on- or off-premises consumption. The ABLE Commission shall\n\npromulgate rules for the implementation of a special off-premises\n\npermit consistent with this subsection. The on-premises beer and\n\nwine licensee shall secure the special off-premises permit prior to\n\nselling beer and wine for off-premises consumption.\n\nB. Sales and service of beer and wine by holders of on-premises\n\nbeer and wine licenses shall be limited to the licensed premises of\n\nthe licensee unless the holder of the on-premises beer and wine\n\nlicense also obtains a caterer license. An on-premises beer and\n\nwine license shall only be issued in counties of this state where\n\nthe sale of alcoholic beverages by the individual drink for on-\n\npremises consumption has been authorized. A separate license shall\n\nbe required for each place of business. No spirits shall be stored,\n\npossessed or consumed on the licensed premises of an on-premises\n\nbeer and wine license, unless the premises also has a mixed beverage\n\nlicense.\n\nC. Holders of an on-premises beer and wine license with a\n\nlicensed premises on a business establishment that meets the\n\nclassification of a golf course or country club pursuant to the most\n\nrecently adopted North American Industry Classification System\n\n(NAICS) may also sell beer in sealed original packages for on-\n\npremises consumption. Such holders' sales of more than two (2)\n\nsealed original packages to one person at one time for on-premises\n\nconsumption shall not be considered an unlawful inducement to\n\nstimulate consumption of alcoholic beverages under the Oklahoma\n\nAlcoholic Beverage Control Act, and patrons may remove sealed\n\noriginal packages from the licensed premises.","path":["OK Code","Title 37A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os37A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cbb47118609b4dbf9d31b152c95a435607b5e2695fdb6305899bdf8977a00f64","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-37a-37a-2-127","next":"us-ok/okla.-stat.-tit.-37a-37a-2-129"},"notice":"GroundRules: Original legal text.
