Stat. tit. 37A, § 37A-2-129","heading":"Charitable auction or charitable alcoholic beverage","body":"event license.\n\nA. A charitable auction or charitable alcoholic beverage event\n\nlicense may be issued to a charitable organization exempt from\n\ntaxation under Section 501(c)(3), (4), (5), (6), (7), (8), (9), (10)\n\nor (19) of the United States Internal Revenue Code. The charitable\n\nalcoholic beverage event license shall authorize the holder thereof\n\nto conduct a wine, spirit and/or beer event which may consist of one\n\nor more of a wine, spirit and/or beer-tasting event, a wine, spirit\n\nand/or beer dinner event or a wine, spirit and/or beer auction,\n\nwhich may be either a live auction conducted by an auctioneer or a\n\nsilent auction for which:\n\n1. Bid sheets are accepted from interested bidders at the\n\nevent;\n\n2. The holders of tickets are allowed to bid online for a\n\nperiod not exceeding thirty (30) days prior to the event; or\n\n3. Both bid sheets are accepted at the event and online bids\n\nare accepted pursuant to paragraph 2 of this subsection.\n\nB. A charitable alcoholic beverage event shall be conducted\n\nsolely to raise funds for charitable purposes. A charitable\n\nalcoholic beverage license shall allow the event attendees access to\n\ntastings, samples, dinners and alcoholic beverages as parts of their\n\nentrance fee or ticket price. Wine, spirits and/or beer used in,\n\nserved or consumed at a charitable alcoholic beverage event may be\n\npurchased by the charitable organization or donated by any person or\n\nentity.\n\nC. The charitable alcoholic beverage event license shall be\n\nissued for a period not exceeding four (4) days. Only eight such\n\nlicenses may be issued to an organization in any twelve-month\n\nperiod. The charitable organization holding a charitable alcoholic\n\nbeverage event license shall not be required to obtain a special\n\nevent license.\n\nD. Charitable auction and charitable alcoholic beverage event\n\nlicense holders may also utilize a licensed caterer to provide\n\nadditional alcohol services at the event and on the premises.\n\nE. The charitable auction license shall authorize the holder\n\nthereof to auction wine, spirits and/or beer purchased from a retail\n\npackage store or received as a gift from an individual if the\n\nauction is conducted to raise funds for charitable purposes. The\n\ncharitable auction license shall be issued for a period not to\n\nexceed two (2) days. Only four such licenses shall be issued to an\n\norganization in any twelve-month period. The maximum amount of\n\nwine, spirits and/or beer auctioned pursuant to the charitable\n\nauction license shall not exceed fifty (50) gallons. All wines,\n\nbeer and spirits auctioned pursuant to the charitable auction\n\nlicense shall be registered and all fees and taxes shall be paid in\n\naccordance with the Oklahoma Alcoholic Beverage Control Act.\n\nF. No charitable alcoholic beverage event license shall be\n\nrequired for an organization, association or nonprofit corporation\n\nwhich is an economic development chamber or similar entity, provided\n\nthe event is not conducted primarily for fundraising purposes, and\n\nprovided the services of a licensed caterer are used to provide and\n\ndistribute the alcoholic beverages at the event.","path":["OK Code","Title 37A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os37A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f8f13b748700e6871c6a50fee2ce3990f019dd908a321e6d0b7cc024cf0346fb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-37a-37a-2-128","next":"us-ok/okla.-stat.-tit.-37a-37a-2-130"},"notice":"GroundRules: Original legal text.
