All distillers, winemakers, and spirits manufacturers,\n\nimporters, brokers and others seeking to sell wine and spirits in\n\nOklahoma, regardless of whether such sales are consummated within or\n\nwithout the state, must either obtain a manufacturer's license or\n\ncontract with a person that maintains a nonresident seller license\n\nin order to sell wine and spirits intended for consumption within\n\nthe State of Oklahoma.\n\nA manufacturer's license or nonresident seller license shall\n\nauthorize the holder thereof to solicit and take orders for wine and\n\nspirits from the holders of licenses authorized to import the same\n\ninto this state, and to ship or deliver, or cause to be shipped or\n\ndelivered, wine and spirits into Oklahoma pursuant to such sales.\n\nB. The ABLE Commission may, subject to the provisions of the\n\nOklahoma Alcoholic Beverage Control Act requiring notice and hearing\n\nin the case of sanctions against holders of licenses, suspend or\n\nrevoke a brewer's license, manufacturer's license or nonresident\n\nseller license for any violation of the Oklahoma Alcoholic Beverage\n\nControl Act by the holder thereof.\n\nC. No licensee in this state authorized to import alcoholic\n\nbeverages into this state shall purchase or receive any alcoholic\n\nbeverages from without this state from any person not holding a\n\nvalid and existing brewer, small brewer, manufacturer's or\n\nnonresident seller license. Every manufacturer's license or\n\nnonresident seller license shall expire on the June 30 following its\n\nissuance or renewal, and shall be eligible for subsequent renewal\n\nterms of one (1) year beginning on the July 1 following each\n\nexpiration. License fees for a new or initial manufacturer's\n\nlicense or nonresident seller license applied for after July 1 may\n\nbe prorated through the following June 30 on a quarterly basis.\n\nD. The holder of a manufacturer's license or nonresident seller\n\nlicense shall, promptly upon consignment of any wine and spirits to\n\nan importer in Oklahoma, forward to the ABLE Commission a true copy\n\nof the invoice, bill of lading or other document as the ABLE\n\nCommission may by rule prescribe, showing the details of such\n\nshipment.\n\nE. Any person, not otherwise a dealer in alcoholic beverages,\n\ncoming into possession of any alcoholic beverages as security for or\n\nin payment of a debt, or as an insurer or its transferee or assignee\n\nfor the salvage or liquidation of an insured casualty or damage or\n\nloss, or as an executor, administrator, trustee or other fiduciary,\n\nmay sell the beverages in one lot or parcel to a duly licensed\n\nwholesaler or beer distributor at an agreed-upon price without\n\nregard to current posted prices. However, immediately after taking\n\npossession of the alcoholic beverages, the person shall register\n\nwith the Director and furnish a detailed list of the alcoholic\n\nbeverages and post with the Director a bond in such amount as the\n\nDirector deems sufficient to protect the state from any taxes due on\n\nthe alcoholic beverages. The person shall pay to the Director a\n\nregistration fee of Fifty Dollars ($50.00), which fee shall permit\n\nthe sale of only the alcoholic beverages detailed in the\n\nregistration request. A wholesaler or beer distributor receiving a\n\nlot or parcel of alcoholic beverages pursuant to this subsection may\n\nsell it in one lot or parcel or more than one lot or parcel to a\n\nlicensed package store or mixed beverage licensee or more than one\n\nlicensed package store or mixed beverage licensee at an agreed-upon\n\nprice without regard to current posted prices; provided, the total\n\nof the lots sold by the wholesaler or beer distributor shall not\n\nexceed four (4) lots.","path":["OK Code","Title 37A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os37A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"03438be3071cb68f9c8c36b1dd65f149912a7a9ec4fd3d5445591a1afab393d9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-37a-37a-2-134","next":"us-ok/okla.-stat.-tit.-37a-37a-2-136"},"notice":"GroundRules: Original legal text.
