Stat. tit. 37A, § 37A-2-159","heading":"Complimentary beverage license","body":"A complimentary beverage license shall authorize the holder\n\nthereof: To provide, free of charge for on premises consumption\n\nonly, no more than two alcoholic beverages containing spirits,\n\ntwelve (12) ounces of wine, or twenty-four (24) ounces of beer per\n\nday, to a guest or client who is twenty-one (21) years of age or\n\nolder. This license shall not be issued to a business which\n\npossesses any other form of license issued by the ABLE Commission,\n\nexcept for event-type licenses. Complimentary beverage licenses\n\nshall only be issued to a business located in a building or\n\nstructure that has a permanent physical address. This license shall\n\nonly be issued to businesses which involve retail sales or provide\n\nservices to its clients including, but not limited to, furniture\n\nstores, art studios, nail salons, hair salons, cigar stores,\n\nclothing stores, bridal shops or business support services. A\n\nchamber of commerce, main street, economic development authority,\n\nvocational trade school, higher education college or similar\n\norganization promoting economic development or an organization that\n\nis exempt from taxation pursuant to the provisions of subsection (c)\n\nof Section 501 of the United States Internal Revenue Code shall also\n\nqualify for a complimentary beverage license. A business whose\n\npatronage is primarily persons under the age of eighteen (18), is a\n\nrestaurant or a business that provides adult entertainment shall not\n\nqualify for a license. Upon issuance of the license, the business\n\nshall purchase all of its alcoholic beverages from a brewer,\n\nwinemaker, retail spirit, retail beer, or retail wine licensee and\n\nwill become a licensed premise subject to inspection by any ABLE\n\nCommission agent or any other peace officer, pursuant to Section 5-\n\n115 of Title 37A of the Oklahoma Statutes. Employees who serve the\n\nalcoholic beverage shall be twenty-one (21) years of age or older\n\nand shall not be required to obtain an employee license. A\n\ncomplimentary beverage license shall not be used in lieu of a mixed\n\nbeverage, caterer, brew pub, brewer, public event, special event,\n\nbeer and wine, or charitable event license. This license is an\n\nannual license and renewable on an annual basis.\n\nA chamber of commerce, main street, economic development\n\nauthority, vocational trade school, higher education college or\n\nsimilar organization promoting economic development shall be exempt\n\nfrom the permanent location requirement and permitted to utilize the\n\nlicense at other locations within the city in which they are located\n\nor on their campus for member recruitment, education and development\n\nof new business functions.\n\nThe holder of an Oklahoma winery or brewers license may serve\n\nfree samples and offer for sale sealed product for off premises\n\nconsumption at temporary tastings on the premises of a complimentary\n\nbeverage licensee.","path":["OK Code","Title 37A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os37A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d29f7b6d833ae8b3f27350ff784a73c7ba13c24c535e17e7ac7a44cd0cf9cf65","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-37a-37a-2-158","next":"us-ok/okla.-stat.-tit.-37a-37a-2-160"},"notice":"GroundRules: Original legal text.
