Stat. tit. 37A, § 37A-2-163","heading":"Free samples at events — Requirements","body":"A holder of a small farm winery, winemaker, or small brewer\n\nlicense, which serves wine or beer for on-premises or off-premises\n\nconsumption, with permission from the event coordinator, manager, or\n\nthe property owner, shall be allowed to serve free samples of, sell,\n\nor serve Oklahoma-manufactured beer, wine, mulled wine, or spiced\n\nwine, mixed with nonalcoholic beverages or food items, such as\n\nwater, sugar, fruits and vegetables, at any temperature, wine\n\nproduced at the winery or blended on-site at any public event,\n\nincluding but not limited to festivals, trade shows, boat shows, RV\n\nshows, home and garden shows, fairs, car shows, swap meets, sporting\n\nevents, city events, county events, state events, for either on-\n\npremises or off-premises consumption, including any public events\n\nthat are held at the premises which hold a retail beer license,\n\nretail spirits license, mixed beverage license, beer and wine\n\nlicense, caterer's license, special event license, public event\n\nlicense, winemaker license, small farm winery license, charitable\n\nauction license, or brewpub license. When attending a public event,\n\nthe location within the event occupied by the small farm winery,\n\nwinemaker, or small brewer licensee becomes a licensed premises and\n\nextension of the licensed small farm winery, winemaker, or small\n\nbrewer license. The licensee shall set up and define an area\n\ncontiguous to their booth space as a serving area where the wine or\n\nbeer is dispensed. The licensee may only serve the wine or beer in\n\nthe serving area. In the event that multiple winemakers or small\n\nbrewers are at the same public event, they may combine their serving\n\nareas into one area as long as they are contiguous to the\n\nwinemakers' or small brewers' booths. A small farm winery,\n\nwinemaker, or small brewer licensee shall not be required to control\n\nthe consumer leaving the premises once served Oklahoma-manufactured\n\nbeer, wine, mulled wine, or spiced wine, mixed with nonalcoholic\n\nbeverages or food items, such as water, sugar, fruits and\n\nvegetables, at any temperature, wine produced at the winery or\n\nblended on-site at the public event.
