Stat. tit. 37A, § 37A-3-103","heading":"Filing of rules by Commission - Notice of license","body":"applicants to be sent to municipalities or county commissioners,\n\ncounty sheriff, district attorney and chief of police.\n\nAll rules of the ABLE Commission shall be promulgated and filed\n\npursuant to the provisions of the Administrative Procedures Act, and\n\nalso shall be filed with the Secretary of State and the State\n\nLibrarian pursuant to the provisions of Sections 251 through 253 of\n\nTitle 75 of the Oklahoma Statutes. Copies of all rules shall be\n\nmade available to each county clerk, district attorney, sheriff and\n\nchief of police in the state upon request.\n\nThe ABLE Commission shall send a notice of application for a\n\nlicense to sell alcohol, alcoholic beverage, wine or beer under the\n\nOklahoma Alcoholic Beverage Control Act to the district attorney of\n\nthe county wherein the premises is located at least fifteen (15)\n\ndays prior to the approval or disapproval of the application.\n\nFor any applicant for a license issued pursuant to the\n\nprovisions of the Oklahoma Alcoholic Beverage Control Act whose\n\nplace of business for which the license is being sought is located\n\nin a city or town, the ABLE Commission shall mail a notice of\n\napplication to the chief of police of the city or town, the sheriff\n\nof the county in which the city or town is located, and the district\n\nattorney of the county in which the city or town is located. The\n\ncity or town may make recommendations on whether or not the\n\napplicant should be issued a license by the ABLE Commission within\n\ntwenty (20) days after the date the copies of the application were\n\nmailed.\n\nFor any applicant for a license issued pursuant to the\n\nprovisions of the Oklahoma Alcoholic Beverage Control Act whose\n\nplace of business for which the license is being sought is located\n\noutside of the incorporated boundaries of a city or town, the ABLE\n\nCommission shall mail a notice of application to the board of county\n\ncommissioners of the county in which the place of business is\n\nlocated, the sheriff of the county and the district attorney of the\n\ncounty. The board of county commissioners shall make\n\nrecommendations on whether or not the applicant should be issued a\n\nlicense by the ABLE Commission within twenty (20) days after the\n\ndate the copies of the application were mailed.\n\nAny political subdivision which is entitled to notice of an\n\napplication for a license shall be considered an interested party to\n\nthe proceeding and shall be given notice of any issuance of license.\n\nThe political subdivision shall be entitled to appeal any such\n\nissuance in the same manner as the applicant would be entitled to\n\nappeal a denial of the license application.","path":["OK Code","Title 37A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os37A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"021c13ed3eecd7cb5836ead7ad3ffd8958ec1a9ce45593026bd92fd175718830","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-37a-37a-3-102","next":"us-ok/okla.-stat.-tit.-37a-37a-3-104"},"notice":"GroundRules: Original legal text.
