A licensed distributor designated as the licensed\n\ndistributor for a beer brand within a designated sales territory\n\nshall present that beer brand for sale to all on-premise licensees\n\non the same price basis and without discrimination and to all off-\n\npremise licensees on the same price basis within a particular county\n\nand without discrimination. A licensed distributor shall not sell,\n\nsupply or deliver, either directly or indirectly through a third\n\nparty, a beer brand to a licensed retailer outside of the designated\n\nsales territory of the designated distributor nor to any person the\n\nlicensed distributor has reason to believe will sell or supply any\n\nquantity of the beer brand to any retail location outside of the\n\ndesignated sales territory of the designated distributor.\n\nB. All beer shall only be transported by a marked conveyance\n\nowned or leased by the licensed distributor and operated by the\n\nlicensed distributor or an employee of the distributor for the\n\nproducts of a licensed brewer or cider manufacturer within the\n\ndesignated sales territory to the address and location of a licensed\n\nretailer within that designated sales territory.\n\nC. Any beer sold by the licensed distributor shall not be\n\ndelivered to, received by or stored at any place other than the\n\naddress and location of the licensed retailer for which state and\n\nlocal retailer licenses or permits have been issued, except as\n\notherwise provided by law.\n\nD. With the approval of the licensed brewer or cider\n\nmanufacturer, a licensed distributor may sell the designated brands\n\nto a licensed retailer located in a designated sales territory of\n\nanother licensed distributor if that licensed distributor is\n\ntemporarily unable for any reason to provide the designated brands\n\nof the licensed brewer or cider manufacturer within its designated\n\nsales territory.\n\nE. All beer purchased by a licensed distributor for resale in\n\nthis state shall physically come into the possession of the licensed\n\ndistributor and be unloaded in and distributed from the licensed\n\nwarehouses of the licensed distributor located in this state prior\n\nto being resold in this state.\n\nF. For temporary events, beer distributors shall be permitted\n\nto park full trailers and Waymatics in the supplier area of the\n\nevents for the purposes of pulling and selling product to special\n\nevent, public event, caterer, on-premises beer and wine and mixed\n\nbeverage licensees. A temporary event shall not exceed fourteen\n\n(14) consecutive calendar days in duration. The trailer/Waymatic\n\nshall be deemed an extension of the licensed premises of the beer\n\ndistributor and no separate storage license shall be necessary. The\n\nfollowing shall apply to beer and cider transactions during\n\ntemporary events:\n\n1. Beer distributors shall be permitted to deliver the beer or\n\ncider from the trailer to the selling locations of the licensee(s)\n\nwithin the event;\n\n2. Beer distributors may not sell directly to consumers;\n\n3. Each delivery of beer or cider shall be accompanied by an\n\ninvoice giving the date of purchase and the quantities delivered;\n\n4. At least every fourth day of the event, the distributor\n\nshall generate and deliver a summary invoice. Within three days\n\nafter the end of the event, the beer distributor shall reconcile the\n\ninvoices with the deliveries made during the event and generate and\n\ndeliver a final invoice to be paid immediately upon delivery;\n\n5. For temporary events lasting less than five (5) days and for\n\nuniversity game days, the beer distributor's invoice shall be\n\ngenerated and submitted to the purchasing licensee the first\n\nbusiness day following the event. The licensee shall pay the\n\ninvoice upon receipt; and\n\n6. For all temporary events, the beer distributor has the\n\noption of requiring the purchasing licensee to deliver a check for\nor temporary events lasting less than five (5) days and for\n\nuniversity game days, the beer distributor's invoice shall be\n\ngenerated and submitted to the purchasing licensee the first\n\nbusiness day following the event. The licensee shall pay the\n\ninvoice upon receipt; and\n\n6. For all temporary events, the beer distributor has the\n\noption of requiring the purchasing licensee to deliver a check for\n\nthe full amount of the product contained within the trailer(s) at\n\nthe beginning of the event to be held by the beer distributor\n\npending completion of the event and reconciliation and payment.\n\nSuch a requirement shall not be deemed a consignment sale, a credit\n\ntransaction, or a violation of any rules or law.\n\nThe provisions of this subsection shall apply to small brewer\n\nself-distributors and brewpub self-distributors.","path":["OK Code","Title 37A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os37A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"94a188320dac38275f0d2479196ffc6e31c45a3a68de369e3c455ac18d46cfd7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-37a-37a-3-109","next":"us-ok/okla.-stat.-tit.-37a-37a-3-111"},"notice":"GroundRules: Original legal text.
