Stat. tit. 37A, § 37A-3-114","heading":"Resale of beer restrictions for retailers - Violations","body":"– Penalties.\n\nA. This section applies to all retailers authorized to sell\n\nbeer for consumption off the premises.\n\nB. The holder of a retail beer or retail spirits license may\n\nresell beer only in the packaging in which the holder received the\n\nbeer or may resell the contents of the packages as individual\n\ncontainers.\n\nC. Except for purposes of resale as individual containers, the\n\nlicensee shall not:\n\n1. Mutilate, tear apart or cut apart original packaging in\n\nwhich beer was received; or\n\n2. Repackage beer in a manner misleading to the consumer or\n\nthat results in required labeling being omitted or obscured.\n\nD. The ABLE Commission shall impose the following penalties for\n\na violation of subsection B or C of this section:\n\n1. After notice and hearing, immediately revoke the license of\n\nthe licensee committing the violation; and\n\n2. Impose a fine of not more than One Thousand Dollars\n\n($1,000.00) for each violation.\n\nAny licensee whose license is revoked pursuant to this\n\nsubsection shall not be eligible to reapply for a license for at\n\nleast three (3) months from the date of the revocation. Any stock\n\nof beer in undamaged original packaging in the possession of such\n\nlicensee shall be repurchased by the distributor as long as the\n\nrepurchased inventory falls within the date considered by the brewer\n\nof the product to be appropriate for sale to a consumer.\n\nE. Administrative fines collected pursuant to this section\n\nshall be enforceable in the district courts of this state.
