To assure and control quality, a beer distributor or a\n\nholder of a small brewer self-distribution license or brewpub self-\n\ndistribution license, at the time of a regular delivery, may\n\nwithdraw with the permission of the retailer, a quantity of beer or\n\ncider in undamaged original packaging from the retailer's stock if:\n\n1. The beer distributor or holder of a small brewer self-\n\ndistribution license or brewpub self-distribution license replaces\n\nthe stock with beer or cider of equivalent value brands, quantities,\n\npackaging and alcohol by volume as the beer or cider withdrawn; or\n\n2. The stock is withdrawn before the date, or immediately after\n\nthe date, considered by the brewer of the product to be the date the\n\nproduct becomes inappropriate for sale to a consumer.\n\nB. The provisions of this section shall not apply to beer or\n\ncider that:\n\n1. Has suffered damage at the retail licensee's location,\n\nregardless of the date upon which the product becomes inappropriate\n\nfor sale to a consumer. Beer distributors, small brewer self-\n\ndistributors and brewpub self-distributors are prohibited from\n\ngiving a refund for or replacing beer or cider that was damaged\n\nwhile in the possession of the retail licensee. Retail licensees\n\nare prohibited from requesting or requiring the beer distributor,\n\nsmall brewer self-distributor and brewpub self-distributor to remove\n\nsuch damaged product as a condition of continued business with the\n\nretail licensee; or\n\n2. Has a date for recommended use that expired prior to October\n\n1, 2018. Retail licensees and brewers are prohibited from\n\nrequesting or requiring the beer distributor, small brewer self-\n\ndistributor and brewpub self-distributor to remove such expired beer\n\nor cider as a condition of continued business with the retail\n\nlicensee or brewer.\n\nC.
