Stat. tit. 37A, § 37A-3-116.4","heading":"Top brand products – Offered to all wholesalers","body":"without discrimination.\n\nAny wine or spirit product that constitutes a top brand, as\n\ndefined in this section, shall be offered by the manufacturer for\n\nsale to every licensed wine and spirits wholesaler who desires to\n\npurchase the same on the same price basis and without discrimination\n\nor inducements. \"Top brand\" shall mean those brands constituting\n\nthe top twenty-five brands in total sales of spirits and of wine by\n\nall wholesalers during the past twelve-month period, according to\n\nthe records of the ABLE Commission as revised by the ABLE Commission\n\nquarterly. In order to allow the ABLE Commission to determine the\n\ntop twenty-five brands of spirits and of wine, all wholesalers must\n\nsubmit to the ABLE Commission every sixty (60) days a sworn\n\naffidavit listing their top thirty brands of spirits and of wine in\n\nsales for the previous sixty (60) days, excluding sales to\n\nwholesalers. Wholesalers who choose to purchase any top-brand wine\n\nor spirits product shall comply with the line-item price posting\n\nrequirements of Section 3-116.2 of Title 37A of the Oklahoma\n\nStatutes.
