A retailer may offer for sale and sell alcoholic beverages\n\nwhich are packaged or are to be packaged with nonalcoholic\n\npromotional items, if such packaging and all nonalcoholic\n\npromotional items are provided by the manufacturer or brewer or\n\nagent of the manufacturer or brewer at the expense of the\n\nmanufacturer or brewer or agent of the manufacturer or brewer,\n\nregardless of where such packages are assembled.\n\nB. The manufacturer or brewer or agent of the manufacturer or\n\nbrewer may provide such packaging and any nonalcoholic promotional\n\nitems to the retailer at the retailer's premises, or otherwise, and\n\nmay deliver such packaging and all nonalcoholic promotional items\n\nprovided by the manufacturer or brewer or agent to the retailer by\n\nmeans of common carrier, or otherwise, at no expense to the\n\nretailer, for the retailer to incorporate the alcoholic beverage\n\nproduct of the manufacturer or brewer into the manufacturer's or\n\nbrewer's packaging or with such promotional items.\n\nC. The manufacturers and brewers of alcoholic beverages,\n\nthrough their agents, must make access to the packaging for such\n\nalcoholic beverages with nonalcoholic promotional items available\n\nequally to retailers in this state. Such access to the promotional\n\npackaging is subject to the reasonable supplies of such packaging\n\nand subject to the terms of the manufacturer's or brewer's\n\npromotion. Such access to the manufacturer's or brewer's packaging\n\nby the retailers shall be commensurate to the needs of the retailers\n\nbased on the stock of the manufacturer's or brewer's product carried\n\nby the retailer.
