Stat. tit. 37A, § 37A-3-124","heading":"Voter approval at county special elections or a general","body":"election required for sale of alcoholic beverages on Sundays or by\n\nindividual drink for on-premises consumption.\n\nA. Sale of alcoholic beverages by the individual drink for on-\n\npremises consumption shall be unlawful in any county of this state\n\nunless the sale has been approved by a majority of the registered\n\nvoters of the county voting thereon at a special election called by\n\nthe board of county commissioners or a General Election. Subject to\n\nthe provisions of subsection C of this section, such election shall\n\nbe called by the board of county commissioners upon receipt of a\n\npetition signed by registered voters constituting not less than\n\nfifteen percent (15%) of the total votes cast in the county in the\n\nlast General Election for the Office of Governor, or such election\n\nmay be called by the board of county commissioners upon its own\n\nmotion. At the time such election is called, the proposition shall\n\ninclude those days or portions of days, if any, on which sales of\n\nalcoholic beverages by the individual drink are not authorized. If\n\nthe proposition is the result of a motion of the board of county\n\ncommissioners, then the ABLE Commission shall designate the days or\n\nportions of days, if any, on which the sales of alcoholic beverages\n\nare not authorized. If the proposition is the result of a petition,\n\nsuch petition shall specify days or portions of days, if any, on\n\nwhich the sales of alcoholic beverages are not authorized.\n\nIf, at the Special Election or at a General Election, the\n\nproposition to authorize the sale of alcoholic beverages by the\n\nindividual drink for on-premises consumption fails to be approved by\n\nthe registered voters of the county, the county shall not hold\n\nanother election on whether or not to approve such sales, for at\n\nleast two (2) years from the date the proposition failed to be\n\napproved.\n\nB. Sales of alcoholic beverages on Sundays by retail spirits\n\nlicensees shall be unlawful in any county of this state unless\n\napproved by a majority of the registered voters of the county voting\n\nthereon at a special election called by the board of county\n\ncommissioners or a General Election. Subject to the provisions of\n\nsubsection C of this section, such election shall be called by the\n\nboard of county commissioners upon receipt of a petition signed by\n\nregistered voters constituting not less than fifteen percent (15%)\n\nof the total votes cast in the county in the last General Election\n\nfor the Office of Governor, or such election may be called by the\n\nboard of county commissioners upon its own motion.\n\nC. A proposition otherwise authorized by the provisions of\n\nsubsection A or subsection B of this section shall be placed before\n\nthe voters of the applicable county at an election to be held on the\n\nsame date as:\n\n1. Any regularly scheduled federal, state or county election\n\nheld in that county;\n\n2. A special election held in that county for a federal, state\n\nor county office; or\n\n3.
