No person shall be allowed to enter or remain in the\n\ndesignated bar or lounge area of a bottle club unless that person\n\npossesses a valid membership card for that club issued by the club.\n\nMembership cards issued by a bottle club shall be purchased by the\n\nclub from the ABLE Commission at a cost of Three Dollars ($3.00) per\n\ntemporary membership card and Twenty-five Dollars ($25.00) per\n\nannual membership card. A temporary membership card shall be valid\n\nfor a period of seventy-two (72) consecutive hours from issuance to\n\nthe member. The date of issuance of a temporary membership shall be\n\nclearly and prominently marked upon the card. When the card is\n\nissued to a member by the club, the club may require the member to\n\nreimburse the club for the cost of the card. No membership card\n\nshall be issued to any person under twenty-one (21) years of age.\n\nThe ABLE Commission shall have the authority to promulgate rules\n\nconcerning bottle club membership cards.\n\nB. A bottle club license authorizes alcoholic beverages\n\nbelonging to members of the club to be:\n\n1. Stored, possessed and mixed on club premises; and\n\n2. Served for on-premises consumption to members. Each member\n\nshall be served only from the member's individually owned bottle of\n\nalcoholic beverage which shall be marked with the owner's full name\n\nor code number. Such numbers shall be maintained on the club\n\npremises, available for inspection by employees of the ABLE\n\nCommission or by any peace officer.\n\nPool systems of storage and purchase of alcoholic beverages in a\n\nbottle club are specifically prohibited.\n\nC. The sale, preparation or service of ice or nonalcoholic\n\nbeverages that are sold, prepared or served for the purpose of being\n\nmixed with alcoholic beverages for consumption on the premises where\n\nsuch sale, preparation or service occurs shall be subject to the\n\nsales tax levied by the Oklahoma Sales Tax Code and to any municipal\n\nor county sales taxes.\n\nD. Any bottle club licensee, or employee or agent of such a\n\nlicensee who sells to a member any alcoholic beverage shall be\n\ndeemed guilty of a misdemeanor and upon conviction thereof shall be\n\npunished by a fine of One Thousand Dollars ($1,000.00) and the club\n\nlicense shall be revoked for a period of thirty (30) days. Any\n\nbottle club licensee, or employee or agent of such a licensee who\n\ndelivers or furnishes to a member any alcoholic beverage that does\n\nnot belong to the member shall be deemed guilty of a misdemeanor and\n\nupon conviction thereof shall be punished by a fine of not less than\n\nFive Hundred Dollars ($500.00) nor more than One Thousand Dollars\n\n($1,000.00) and the club license shall be revoked for a period of\n\nthirty (30) days. Any bottle club licensee, or employee or agent of\n\nsuch a licensee who permits any person who is not a member to enter\n\nand remain in the designated bar or lounge area of the club premises\n\nshall be deemed guilty of a misdemeanor and upon conviction thereof\n\nshall be punished by a fine of One Thousand Dollars ($1,000.00) and\n\nthe bottle club license shall be suspended for a period of thirty\ndays. Any bottle club licensee, or employee or agent of\n\nsuch a licensee who permits any person who is not a member to enter\n\nand remain in the designated bar or lounge area of the club premises\n\nshall be deemed guilty of a misdemeanor and upon conviction thereof\n\nshall be punished by a fine of One Thousand Dollars ($1,000.00) and\n\nthe bottle club license shall be suspended for a period of thirty\n\n(30) days. No bottle club licensee, or employee or agent of such a\n\nlicensee shall serve alcoholic beverages to any person that does not\n\npossess a valid membership card for that club issued by the club.\n\nE. Any bottle club licensed under the provisions of the\n\nOklahoma Alcoholic Beverage Control Act shall pay the license fee\n\nprovided by law and obtain a separate license for each separate\n\nplace of business.\n\nF. In counties of this state where retail sale of alcoholic\n\nbeverages by the individual drink has not been authorized, no person\n\nshall serve alcoholic beverages by the individual drink for on-\n\npremises consumption or permit the consumption of alcoholic\n\nbeverages except in a bottle club licensed pursuant to this section\n\nor in a private residence; provided, this shall not prohibit a\n\nwinery from serving visitors on the licensed premises free samples\n\nof wine produced on the premises.
