Except as provided in subsection D of this section, no\n\nalcoholic beverage shall be labeled, offered or advertised for sale\n\nin this state unless in accordance with rules promulgated pursuant\n\nto the provisions of Section 5-130 of this title and unless the\n\nbrand label shall have been registered with and approved by the ABLE\n\nCommission and the appropriate fee paid as provided for in this\n\nsection.\n\nB. An application for registration of a brand label shall be\n\nfiled by and fees paid by the manufacturer or brewer, winemaker,\n\ndistiller or nonresident seller of the brand. Licensees, other than\n\nthe foregoing applicants, shall not be required to verify\n\nregistration to the ABLE Commission and shall not be penalized for\n\nany applicant’s failure to register its brand label in accordance\n\nwith this section. Cordials and wines which differ only as to age\n\nor vintage year, as defined by such rules, shall be considered the\n\nsame brand, and those that differ as to type or class may be\n\nconsidered the same brand by the ABLE Commission where consistent\n\nwith the purposes of this section.\n\nC. The application for registration of a brand label shall be\n\nfiled on a form prescribed by the ABLE Commission, and shall contain\n\nsuch information as the ABLE Commission shall require. Such\n\napplication shall be accompanied by a certified check, bank\n\nofficers’ check or draft or money order in the amount of the annual\n\nregistration fee, or the properly prorated portion thereof\n\nprescribed by this section.\n\nD. 1. The annual fee for registration of any brand label for\n\nspirits shall be Three Hundred Seventy-five Dollars ($375.00),\n\nunless total amount of spirits made available for sale in a single\n\nyear does not exceed fifty-three (53) gallons, in which case the\n\nannual fee for registration of any brand label shall be Seventy-five\n\nDollars ($75.00). The annual fee for registration of any brand\n\nlabel for beer shall be Two Hundred Dollars ($200.00). The annual\n\nfee for registration of any brand label for wine made in the United\n\nStates, or for registration of any category of imported wine as\n\ndefined by the Oklahoma Tax Commission, shall be Two Hundred Dollars\n\n($200.00). Beer manufactured in this state shall be exempt from\n\nbrand label registration fees.\n\n2. Each brand label registered and approved pursuant to this\n\nsection shall be valid for a term of up to one (1) year, expiring on\n\nthe June 30 next following registration, and may be renewed for\n\nsubsequent terms of one (1) year beginning on the July 1 following\n\nthe initial registration. Brand registration fees for labels\n\nregistered after July 1 may be prorated through the following June\n\n30 on a quarterly basis. The brand registration fee shall not be\n\ntransferable, unless otherwise allowed by law. A nonresident seller\n\nwho registered brands prior to May 7, 2019, may transfer brand\n\nregistrations to the brewer or manufacturer that produces those\n\nbrands, provided the brewer or manufacturer has obtained a license,\n\nat no expense to the nonresident seller, brewer or manufacturer.\n\nE. If the ABLE Commission shall deny the application for\n\nregistration of a brand label, it shall return the registration fee\n\nto the applicant, less twenty-five percent (25%) of such fee.\n\nF. The ABLE Commission may at any time exempt any discontinued\n\nbrand from fee provisions of this section where a manufacturer,\n\nbrewer, beer distributor or wholesaler has an inventory of one\n\nhundred cases or less of liquor or wine and five hundred cases or\n\nless of beer, and certifies to the ABLE Commission in writing that\n\nsuch brand is being discontinued.\n\nG.
