Stat. tit. 37A, § 37A-5-133","heading":"Refilling of containers prohibited - Infused drinks","body":"requirements.\n\nA. No holder of a mixed beverage, beer and wine, caterer,\n\nspecial event, public event or airline/railroad beverage license\n\nshall refill with any substance a container which contained any\n\nalcoholic beverage on which the tax levied by Section 104 of this\n\nact has been paid.\n\nB. A mixed beverage licensee shall not be prohibited from\n\npreparing and selling infused drinks on the licensed premises,\n\nprovided the licensee complies with this section. \"Infusion\" is the\n\nprocess in which a distilled spirit has one or more ingredients\n\nincluding but not limited to fruits, vegetables, spices or nuts\n\nadded to the distilled spirit. Provided, it shall not be lawful for\n\na distilled spirit to be infused with any hallucinogenic substances\n\nor to have pure or supplemental caffeine or other stimulants added,\n\nincluding but not limited to guarana, ginseng or taurine. A mixed\n\nbeverage licensee who prepares and sells infused drinks shall comply\n\nwith the following requirements:\n\n1. The infusion shall be mixed and stored on the licensed\n\npremises;\n\n2. The container that the infusion is stored in cannot exceed\n\nfive (5) gallons, must have a lid, and be maintained in sanitary\n\ncondition;\n\n3. The infusion shall not be aged more than fourteen (14) days;\n\n4. The infusion must be used or destroyed within twenty-one\n\n(21) days after the end of the aging process;\n\n5. Cleaning reports for the container must be available for\n\ninspection by the ABLE Commission; and\n\n6.
