No retail spirits licensee shall:\n\n1. Purchase or receive any alcoholic beverage other than from a\n\nwine and spirits wholesaler, beer distributor, winery or small\n\nbrewer self-distribution licensee who elects to self-distribute;\n\n2. Suffer or permit any retail container to be opened, or any\n\nalcoholic beverage to be consumed on the licensed premises, except\n\nwhen serving samples as authorized by Section 2-109 of this title or\n\notherwise permitted by law; provided, the licensee shall not permit\n\nany alcoholic beverage content or retail container unsealed in\n\nconnection with sampling authorized by Section 2-109 of this title\n\nto remain on the licensed premises at the close of business on that\n\nday, excluding spirits;\n\n3. Sell any alcoholic beverages at any hour other than between\n\nthe hours of 8:00 a.m. and midnight Monday through Saturday, and\n\nshall not be permitted to be open on Thanksgiving Day or Christmas\n\nDay; provided, a county may, pursuant to the provisions of\n\nsubsections B and C of Section 3-124 of this title, elect to allow\n\nsuch sales between the hours of noon and midnight on Sunday. Retail\n\nspirits licensees shall be permitted to sell alcoholic beverages on\n\nthe day of any General, Primary, Runoff Primary or Special Election\n\nwhether on a national, state, county or city election, provided that\n\nthe election day does not occur on any day on which such sales are\n\notherwise prohibited by law;\n\n4. Sell spirits in a city or town, unless such city or town has\n\na population in excess of two hundred (200) according to the latest\n\nFederal Decennial Census;\n\n5. Sell any alcoholic beverage on credit; provided, that\n\nacceptance by a licensee of a cash or debit card or a nationally\n\nrecognized credit card in lieu of actual cash payment does not\n\nconstitute the extension of credit; provided, further, as used in\n\nthis section:\n\na. “cash or debit card” means any instrument or device\n\nwhether known as a debit card or by any other name,\n\nissued with or without fee by an issuer for the use of\n\nthe cardholder in depositing, obtaining or\n\ntransferring funds from a consumer banking electronic\n\nfacility, and\n\nb. “nationally recognized credit card” means any\n\ninstrument or device, whether known as a credit card,\n\ncredit plate, charge plate or by any other name,\n\nissued with or without fee by an issuer for the use of\n\nthe cardholder in obtaining money, goods, services or\n\nanything else of value on credit which is accepted by\n\nover one hundred retail locations;\n\n6. Offer or furnish any prize, premium, gift or similar\n\ninducement to a consumer in connection with the sale of alcoholic\n\nbeverages, except that goods or merchandise included by the\n\nmanufacturer in packaging with alcoholic beverages or for packaging\n\nwith alcoholic beverages shall not be included in this prohibition,\n\nbut no wholesaler or retailer shall sell any alcoholic beverage\n\nprepackaged with other goods or merchandise at a price which is\n\ngreater than the price at which the alcoholic beverage alone is\n\nsold; provided, it shall not be considered inducement or a premium\n\nfor a retail spirits licensee to have an advertised price posted\n\nhigher online than the shelf price on the licensed premises; or\n\n7. Pay for alcoholic beverages by a check or draft which is\n\ndishonored by the drawee when presented to such drawee for payment;\n\nand the ABLE Commission may cancel or suspend the license of any\n\nretailer who has given a check or draft, as maker or endorser, which\n\nis so dishonored upon presentation.\n\nB. No retail spirits licensee shall permit any person under\n\ntwenty-one (21) years of age to enter into or remain within or about\n\nthe licensed premises unless accompanied by the person’s parent or\n\nlegal guardian; provided, however, this restriction shall not apply\n\nto an employee of a licensed beer distributor or wine and spirits\n\nwholesaler who:\n\n1. Is at least eighteen (18) years of age;\nion.\n\nB. No retail spirits licensee shall permit any person under\n\ntwenty-one (21) years of age to enter into or remain within or about\n\nthe licensed premises unless accompanied by the person’s parent or\n\nlegal guardian; provided, however, this restriction shall not apply\n\nto an employee of a licensed beer distributor or wine and spirits\n\nwholesaler who:\n\n1. Is at least eighteen (18) years of age;\n\n2. Is accompanied by a coworker at least twenty-one (21) years\n\nof age; and\n\n3.
