Stat. tit. 37A, § 37A-6-105","heading":"Prohibited acts of mixed beverage, public event,","body":"special event or on-premises beer and wine licensees.\n\nNo mixed beverage, public event, special event or on-premises\n\nbeer and wine licensee shall:\n\n1. Purchase or receive any alcoholic beverage other than from a\n\nperson holding a wine and spirits wholesaler or beer distributor\n\nlicense issued pursuant to the Oklahoma Alcoholic Beverage Control\n\nAct; provided, a mixed beverage or on-premises beer and wine\n\nlicensee whose premises are a restaurant may purchase wine produced\n\nat wineries in this state directly from a winemaker as provided in\n\nSection 2 of Article XXVIII-A of the Oklahoma Constitution;\n\n2. Transport alcoholic beverages from the place of purchase to\n\nthe licensed premises unless the licensee also holds a private\n\ncarrier license issued by the ABLE Commission;\n\n3. Use or allow the use of any mark or label on a container of\n\nalcoholic beverage which is kept for sale which does not clearly and\n\nprecisely indicate the nature of the contents or which might deceive\n\nor conceal the nature, composition, quantity, age or quality of such\n\nbeverage;\n\n4. Keep or knowingly permit any alcoholic beverage to be kept,\n\nbrought, or consumed on the licensed premises which is not allowed\n\nto be sold or served upon such premises; provided, that the\n\nalcoholic beverage may be provided by a wine and spirits wholesaler,\n\nbeer distributor, brewer, small brewer, distiller, winemaker, small\n\nfarm winery, rectifier, manufacturer, or nonresident seller licensee\n\nand kept, brought, or consumed on the licensed premises for\n\neducational training tasting purposes pursuant to Section 6-109 of\n\nthis title; or\n\n5. Allow any person under twenty-one (21) years of age to enter\n\ninto, remain within or loiter about the designated bar area of the\n\nlicensed premises, except for persons who incidentally pass through\n\nthe designated area.\n\nThe prohibition in this subsection against persons under twenty-\n\none (21) years of age entering or remaining within the designated\n\nbar area of the licensed premises shall not apply:\n\na. if the licensed premises are closed to the public\n\nduring a time the premises are legally permitted to be\n\nopen for business and the premises are used for a\n\nprivate party at which alcoholic beverages may be\n\nserved to persons twenty-one (21) years of age or\n\nolder. Any alcoholic beverages served at a private\n\nparty on the licensed premises may be purchased from\n\nthe licensee at a negotiated price or purchased\n\nprivately and served at the private party on the\n\nlicensed premises. Any licensee who desires to\n\nconduct such a private party shall notify the ABLE\n\nCommission, in writing, at least ten (10) calendar\n\ndays prior to the private party. The notification\n\nshall include the date, time and purpose of the\n\nprivate party and any other information the ABLE\n\nCommission may deem necessary,\n\nb. to a designated bar area which is a concession stand\n\nserving beer and wine, in addition to food and non-\n\nalcoholic beverages, which concession stand is located\n\nat, in, or on the premises of a sports, music or\n\nentertainment venue, convention center, fairgrounds or\n\nsimilar facility, or\n\nc. to an employee of a beer distributor or wine and\n\nspirits wholesaler who is at least eighteen (18) years\n\nof age and enters for the purpose of merchandising or\n\ndelivering product to the licensee in the normal\n\ncourse of business.","path":["OK Code","Title 37A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os37A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4c721b6e0930c1cdc880f6f8add0ec68db75b67a1c46d06ca2c8383c0598952a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-37a-37a-6-104","next":"us-ok/okla.-stat.-tit.-37a-37a-6-106"},"notice":"GroundRules: Original legal text.
