Applications for organization licenses must be filed with\n\nthe Commission at a time and place prescribed by the rules and\n\nregulations of the Commission. Beginning with organization license\n\napplications for the 1994 calendar year, the Commission shall\n\ndevelop and use separate application forms for applicants requesting\n\nan organization license to conduct horse racing with the pari-mutuel\n\nsystem of wagering and applicants requesting an organization license\n\nto conduct horse racing without the pari-mutuel system of wagering.\n\nFor use for the 1993 calendar year organization licenses, an\n\napplicant requesting to conduct horse racing without the pari-mutuel\n\nsystem of wagering shall make application with the Commission on\n\nAmerican Quarter Horse Association application forms. Applications\n\nfor an organization license to conduct horse racing without the\n\npari-mutuel system of wagering for the 1993 calendar year shall be\n\nfiled with the Commission on or before the 1st day of August, 1992.\n\nEach applicant requesting an organization license to conduct horse\n\nracing with the pari-mutuel system of wagering shall include with\n\neach application a nonrefundable license fee equal to the sum of\n\nFive Thousand Dollars ($5,000.00) for each race meeting and Two\n\nHundred Dollars ($200.00) for each racing day requested. Provided,\n\nthe fee for Five Thousand Dollars ($5,000.00) shall be waived for\n\napplicants applying pursuant to the provisions of Section 208.2 of\n\nthis title. Each applicant requesting an organization license to\n\nconduct horse racing without the pari-mutuel system of wagering or\n\nto conduct accredited work or training races shall include with each\n\napplication a nonrefundable license fee of Five Hundred Dollars\n\n($500.00) for each race meeting. Such fee shall be in the form of a\n\ncertified check or bank draft payable to the order of the\n\nCommission. Within thirty (30) days after the date specified for\n\nfiling, the Commission shall examine the applications for compliance\n\nwith the provisions of the Oklahoma Horse Racing Act and such rules\n\nand regulations as may be promulgated by the Commission. If any\n\napplication does not comply with the provisions of the Oklahoma\n\nHorse Racing Act or the rules and regulations promulgated by the\n\nCommission, the application may be rejected or the Commission may\n\ndirect the applicant to comply with the provisions of the Oklahoma\n\nHorse Racing Act or the rules and regulations of the Commission\n\nwithin a reasonable time as determined by the Commission. Upon\n\nproof by the applicant of compliance, the Commission may reconsider\n\nthe application. If it is found to be in compliance with the\n\nprovisions of the Oklahoma Horse Racing Act and the rules and\n\nregulations of the Commission, the Commission may then issue an\n\norganization license to the applicant.\n\nB. The Commission may exercise discretion in the issuing of\n\norganization licenses to qualified applicants. The Commission may\n\nalso determine and grant racing dates different from those requested\n\nby the applicants in their applications.\n\nC. The Commission may determine and grant the number of racing\n\ndays to be allotted to each applicant. When granting organization\n\nlicenses and allocating dates for race meetings which will, in the\n\njudgment of the Commission, be conducive to the best interests of\n\nthe public and the sport of horse racing, the Commission shall give\n\nconsideration to:\n\n1. The character, reputation, experience, and financial\n\nintegrity of each applicant and of any other person that:\n\na. directly or indirectly controls such applicant, or\n\nb. is directly or indirectly controlled by such applicant\n\nor by a person who directly or indirectly controls\n\nsuch applicant; and\ns Page 26\n\nthe public and the sport of horse racing, the Commission shall give\n\nconsideration to:\n\n1. The character, reputation, experience, and financial\n\nintegrity of each applicant and of any other person that:\n\na. directly or indirectly controls such applicant, or\n\nb. is directly or indirectly controlled by such applicant\n\nor by a person who directly or indirectly controls\n\nsuch applicant; and\n\n2. The facilities and accommodations of the applicant for the\n\nconduct of race meetings; and\n\n3. The location of the race meeting of the applicant in\n\nrelation to the principal centers of population of this state; and\n\n4. The highest prospective total revenue to be derived by the\n\nstate from the conduct of the race meeting.\n\nD. Prior to the issuance of an organization license to conduct\n\npari-mutuel race meetings, the applicant shall file with the\n\nCommission a bond payable to the State of Oklahoma in an amount\n\ndetermined by the Commission which is not less than Two Hundred\n\nThousand Dollars ($200,000.00) and not more than the total financial\n\nliability of the organization licensee throughout the race meeting\n\nfor which the organization license is requested, executed by the\n\napplicant and a surety company or companies authorized to do\n\nbusiness in this state, and conditioned upon the payment by the\n\norganization licensee of all taxes and other monies due and payable\n\npursuant to the provisions of the Oklahoma Horse Racing Act and all\n\npurses due and payable, and upon the fact that, upon presentation of\n\nwinning tickets, the organization licensee will distribute all sums\n\ndue to the patrons of pari-mutuel pools. The financial liabilities\n\nincurred by the organization licensee in the form of real estate\n\nmortgages shall not be included in the determination of the bond\n\namount.\n\nE. The Commission shall notify each applicant of the racing\n\ndates allotted to such applicant. The notice shall be in writing\n\nand sent by registered mail to the applicant at the address stated\n\nin the application. The notice shall be mailed within two (2)\n\nbusiness days of the date the allotment is made. After the mailing\n\nof such notice of allotment, each applicant shall file with the\n\nCommission within ten (10) days an acceptance of such allotment on a\n\nform prescribed and furnished by the Commission.\n\nF. Each organization license shall specify the name of the\n\nperson to whom it is issued, the dates upon which horse racing is\n\npermitted, and the location, place, track, or enclosure where the\n\nrace meeting is to be held.\n\nG. All employees of an organization licensee shall be citizens\n\nof the United States, and not less than ninety percent (90%) of such\n\nemployees shall be residents of this state for not less than\n\neighteen (18) months immediately preceding such employment.\n\nH. All horse racing conducted pursuant to the provisions of an\n\norganization license is subject to the provisions of the Oklahoma\n\nHorse Racing Act and of the rules, regulations and directives\n\npromulgated by the Commission, and every organization license issued\n\nby the Commission shall contain a statement to that effect.\n\nI. Any organization licensee may provide, with prior approval\n\nby the Commission, that at least one horse race a day may be devoted\n\nto the racing of a type of horse which is different from the type of\n\nhorse being raced in the other races conducted by the organization\n\nlicensee on that day. When scheduled races are trial heats for\n\nfuturities or stakes races electronically timed from the starting\n\ngates, no organization licensee shall move the starting gates or\n\nallow the starting gates to be moved until all trial heats are\n\ncomplete, unless they are using a device approved by the horsemen's\n\nrepresentative and the stewards that will ensure the gates are set\n\nin the same position, except in an emergency as determined by the\n\nstewards.\n\nJ. Organization licenses may be revoked if the organization\ns, no organization licensee shall move the starting gates or\n\nallow the starting gates to be moved until all trial heats are\n\ncomplete, unless they are using a device approved by the horsemen's\n\nrepresentative and the stewards that will ensure the gates are set\n\nin the same position, except in an emergency as determined by the\n\nstewards.\n\nJ. Organization licenses may be revoked if the organization\n\nlicensee or any person owning an interest in the organization\n\nlicensee:\n\n1. Violates any provision of the Oklahoma Horse Racing Act; or\n\n2. Violates any provision of the rules and regulations\n\npromulgated pursuant to the provisions of the Oklahoma Horse Racing\n\nAct; or\n\n3. Has been convicted of a felony; or\n\n4. Has been convicted of violating any law regarding gambling\n\nor controlled dangerous substances of the United States, this state,\n\nor any other state; or\n\n5. Has failed to disclose or has stated falsely any information\n\ncontained in the application; or\n\n6. Has concealed in whole or in part the true ownership of the\n\norganization licensee.\n\nAny organization license revocation proceeding shall be\n\nconducted pursuant to the provisions of Sections 302 through 323 of\n\nTitle 75 of the Oklahoma Statutes.\n\nK. The fees received by the Commission pursuant to the\n\nprovisions of this section shall be apportioned to the Oklahoma\n\nHorse Racing Commission Operational Expenses Revolving Fund.\n\nL.
